RESOLUTION NO. 1006, 2025
PROVIDING FOR THE ACQUISITION OF LOT 3164 BY EMINENT DOMAIN
SITUATE AT HONOULIULI, ‘EWA, O’AHU, HAWAI’I
TAX MAP KEY: 9-1-031:008
BE IT RESOLVED by the Board of Water Supply, City and County of Honolulu:
I.
That for public use and purposes, to-wit, provide access to, and support the development, operation and maintenance of, a seawater desalination facility that is resilient to climate change, environmentally sustainable, and consistent with the ‘Ewa Development Plan’s directed growth policies, proceedings in eminent domain as provided by the law be instituted for the acquisition of the subject real property described in the attached Exhibit “A” and shown on Exhibit “B,” which by this reference are incorporated herein and made a part hereof.
The acquisition of the foregoing real property by eminent domain is deemed necessary for the aforesaid public use and purposes.
II.
That the Corporation Counsel of the City and County of Honolulu, or such litigation counsel as the Board of Water Supply may employ pursuant to Section 7-116 of the Revised Charter of the City and County of Honolulu 1973 (Amended 2017 Edition), shall be and is hereby authorized and empowered to institute and carry out said proceedings in the name and on behalf of the Board of Water Supply and the City and County of Honolulu. The Corportion Counsel or such litigation counsel shall be and is hereby further authorized and empowered to negotiate terms of any settlement, subject to the approval of the Board of Water Supply and/or the court before which such proceedings are commenced.

Lot 3164, area of 4.870 acres, more or less, situate at Honouliuli, ‘Ewa, O’ahu, Hawai’i, as shown on Map 325, filed in the Office of the Assistant Registrar of the Land Court of the State of Hawai’i, with Land Court Application 1069 of the Trustees Under the Will and of the Estate of James Campbell, Deceased, and being the land described in Certificate of Title No.753,673 issued to Hawaii MMGD LLC, a Maryland limited liability company.
