The Lana’i Planning Commission of the County of Maui hereby provides notice of a public hearing on June 18, 2025 commencing at 5:00 p.m., or as soon thereafter as is practicable either at a virtual meeting via a videoconferencing platform, or for a hybrid meeting at the Current Planning Division’s Conference Room, One Main Plaza, 2200 Main Street, Suite 619, Wailuku, Hawaii, 96793, and a courtesy testimony site at the Maui County Council, Lana’i District Office, 814 Fraser Avenue (entrance on Gay Street), Lana?i City, Hawaii, 96763 on the following matter (Final location will be set on the meeting agenda):
1. A BILL FOR AN ORDINANCE AMENDING CHAPTER 19.30A (AGRICULTURAL DISTRICT), MAUI COUNTY CODE, WHICH WOULD AMEND THE DEFINITIONS OF “AGRICULTURAL RETAIL STRUCTURE” AND “FARMER’S MARKET” TO INCLUDE “VEHICLE” AND “STRUCTURE ON WHEELS” AS TYPES OF AGRICULTURAL RETAIL STRUCTURES
MS. KATE L. K. BLYSTONE, Planning Director, referring to the Maui, Moloka’i and Lana’i Planning Commissions, a proposed bill to amend Maui County Code Chapter 19.30A; allowing “vehicle” and “structure on wheels” to be added to the definitions of “Agricultural Retail Structure” and “Farmer’s Market.” The bill would allow “vehicle” and “structure on wheels” to be considered as types of structures, thereby allowing them, under certain provisions, to be considered as permitted accessory uses in the Agricultural District. Note that County Council Resolution No. 25-60, FD1, referring this bill to the Planning Commissions for their review, findings and recommendations to the County Council also included a proposed change to Section 16.25.105.2 “Work exempt from permit.” The Planning Commissions are only responsible for reviewing and providing recommendations on proposed land use ordinances affecting Title 19 – Zoning Code and not Title 16 – Buildings and Construction. The subject public hearing will be conducted in accordance with the Hawaii Revised Statutes, the Maui County Code, and Rules of the Lana’i Planning Commission. Information pertaining to the subject application may be obtained from the Maui County Planning Department, 2200 Main Street, Suite 315, Wailuku, Maui, or planning@mauicounty.gov if offices are closed to the public. Copies of the subject applications will be mailed to any interested person who requests a copy and pays the required fees for copying and postage.
Unless otherwise specified by another planning commission rule, any petition to intervene as a formal party in the proceedings before the Commission must be filed with the Commission and served upon the applicant no less than ten (10) days before the first public hearing date. (Note: The calculation of time for deadlines ten days or less excludes weekends and State recognized holidays.) All testimony regarding the subject application may be filed prior to the date of the hearing by providing 15 copies of said written testimony to the Department Planning or via email or may be presented at said hearing if the hearing is not closed to the public. Written testimony may be submitted by mail to: Planning Department, 2200 Main Street, Suite 315, Wailuku, Maui, Hawaii 96793 or by email to planning@mauicounty.gov. Written testimony should be submitted two business days prior to the public hearings to ensure distribution to the commissioners; however, testimony submitted after such date will still be accepted by the Commission until the closing of public testimony at the hearing. Further information will be provided on the posted meeting agenda.
