NOTICE OF PUBLIC HEARING & REQUEST FOR PUBLIC COMMENTS
ON PROPOSED AMENDMENTS TO
THE HAWAII ADMINISTRATIVE RULES (HAR)
TITLE 11, CHAPTER 60.1 AIR POLLUTION CONTROL

Pursuant to Hawaii Revised Statutes, Chapter 91, The State of Hawaii Department of Health (DOH), Clean Air Branch (CAB) will accept written comments and hold a public hearing on the proposed amendments of the HAR, Title 11, Chapter 60.1 on Air Pollution Control.
The proposed amendments align state regulations with updates to the U.S. Environmental Protection Agency’s (EPA) regulations or directives, allows training provisions for non-structural firefighting, and includes additional conditions that apply to no-burn periods.
The proposed amendments address the following:
Removal of the emergency affirmative defense provision for air pollution control permits; and
Improvement and clarification of open burning provisions.
DOH invites comments regarding Native Hawaiian traditional and customary rights that may be affected or impaired by the proposed rules.
