Notice of Destruction of Special Education Records

Dear Parents/Guardians and Former Students:
In accordance with 34 C.F.R § 300.624, the federal regulation under the Individuals with Disabilities Education Act (IDEA), the Hawai’i State Department of Education (Department) must inform parents when personally identifiable information is collected, maintained, or used under this part is no longer needed to provide education services to the child. Special Education records related to the identification, evaluation, educational placement, or the provision of special education, must be maintained under state and federal law for a period of three (3) years after a student graduates with a regular diploma or ages out at the 22nd birthday.
This notification is to inform you of the Department’s intent to destroy the Special Education records for those students who graduated with a diploma or aged out at their 22nd birthday before July 1, 2021. If you would like to request a hard copy of the records, please contact your respective district or complex area by using the phone list below. Records must be claimed by Monday, December 30, 2024. All unclaimed hard copies of records will be destroyed after December 30, 2024.
