NOTICE TO ATTORNEYS INTERESTED IN
PROVIDING LEGAL SERVICES TO THE
DEPARTMENT OF LAND AND NATURAL RESOURCES
AS A HEARING OFFICER IN THE
MARCONI POINT ALLEGED VIOLATION CONTESTED CASE
(Pursuant to HRS §103D-304)
The Department of Land and Natural Resources seeks qualified applicants to provide professional legal services as a hearing officer and to hold a contested case hearing or hearings with respect to the requests for administrative fines and other penalties for the alleged “take” (killing) of two species of endangered Nalo Meli Maoli (aka Hawaiian Yelllow-Faced Bees), and Conservation District Enforcement OA 24-14 regarding the alleged unauthorized clearing of land, unauthorized removal of trees, unauthorized spreading of mulch, unauthorized fence lines and encroachment and removal of resources upon State land located at and makai (seaward) of TMK: (1) 5-6-003:053 Marconi Point Condominium Property, Kahuku, island of Oahu. The decisions to conduct a contested case hearing and use a hearing officer have been approved by the Board of Land and Natural Resources. This solicitation is made for the purposes of identifying qualified candidates.
Qualifications
An applicant must possess the following basic qualifications:
1) Being an attorney licensed to practice law in the State of Hawaii and in good standing;
2) Being able to serve with strict impartiality and no conflicts of interest or appearance of conflict;
3) Being available to devote a substantial amount of time in the next six to twelve months or as long as it may take to conduct the contested case hearing;
4) Willing to accept the prevailing charge rate relevant to the professional service as a hearing officer, as determined by the Department; and
5) Providing a tax clearance certificate, a labor certificate, and a certificate of good standing as required in HRS §103D-310(c) and HAR §3-122-112, which may be processed via an online system known as the “Hawaii Compliance Express”.
Other desirable qualifications include civil litigation experience, practice in administrative law and process, familiarity with government proceedings and procedures, and knowledge of the Hawaii Revised Statutes (HRS) and Hawaii Administrative Rules (HAR) administered by the Department.
