NOTICE OF PUBLIC HEARING
Pursuant to Hawaii Revised Statutes, Chapter 91, notice is hereby given that the State of Hawaii, Department of Transportation, will hold a public hearing to consider the proposed adoption of Hawaii Administrative Rules Chapter 19-152, State Highway Enforcement Program.
The purpose of the proposed rules is to carry out the purposes of Act 250 Session Laws of Hawaii 2019 requiring the Department of Transportation to adopt rules to:
a. Establish the state highway enforcement program.
b. Add a $200.00 surcharge for illegal parking to existing penalties for violations of the statewide traffic code involving stopping, standing, or parking on state highways.
c. Deposit fifty percent of the surcharges into the state highway fund with remaining balance distributed to the respective police departments of the county from where the surcharge was collected to be used to enforce laws and ordinances pertaining to illegal parking on state highways.
d. Provide definition of a curb marking.
Act 250 Session Laws of Hawaii enacted in 2019 was effective on July 1, 2019. Act 239 Session Laws of Hawaii 2023 was effective on July 1, 2023, amended Hawaii Revised Statutes §291C-111 to allow counties by ordinance the option to use the state highway enforcement program and associated $200.00 surcharge.
A virtual public hearing will be held on February 7, 2024, at 9:00 a.m. using Microsoft Teams or you may attend the physical location at 601 Kamokila Boulevard, Design Conference Room 609, Kapolei, Oahu. To request an invitation to the hearing virtually please email rideshare@hawaii.gov at least ten (10) days prior to the hearing.
