To comply with the public participation requirements of Title 40 Code of Federal Regulations part 25 in the enforcement of National Pretreatment Standards, the City and County of Honolulu (CCH), Department of Environmental Services (ENV) provides an annual public notification of Significant Industrial Users (SIU) who, at any time during the period occurring from January 1, 2022 through December 31, 2022 were in Significant Noncompliance (SNC) with applicable pretreatment requirements.

Violation: In accordance with the Revised Ordinance of Honolulu (ROH), Section 14-1.2, CCH finds that PENCO is in SNC for the period July 1, 2022, to September 30, 2022 for failing to provide, within 45 days after the due date, required reports such as baseline monitoring reports, 90-day compliance reports, periodic self-monitoring reports, and reports on compliance with compliance schedules.
Enforcement Action: On September 23, 2022, CCH issued PENCO a Notice of Violation (NOV) for failing to submit within 45 days after the due date of May 15, 2022 the required electronic and hard copy reports for the March 2022 Self-Monitoring Report (SMR).
