NOTICE OF ISSUANCE OF NOTICE OF INTENT TO BIFURCATE CASE and NOTICE OF INITIAL CONFERENCE

TO: A COURT-APPOINTED REPRESENTATIVE OR SPECIAL ADMINISTRATOR OF THE ESTATE OF DANIEL DIAL and the SURVIVORS OF DANIEL DIAL, or legal counsel thereof:
On October 4, 2011, Daniel Dial filed an appeal to the Labor and Industrial Relations Appeal Board and on October 10, 2011, Employer filed a cross appeal. Upon information and belief, Daniel Dial died on February 2, 2012. To date, no court-appointed legal representative of Claimant’s estate has appeared in these appeals.
YOU ARE PROVIDED NOTICE that on
June 23, 2021, the Board issued a Notice of Intent to Bifurcate Case and Notice of Initial Conference. The Board will bifurcate the appeals and dismiss Claimant as a party to Employer’s appeal unless a party files a written objection to such bifurcation with the Board by August 31, 2021. YOU ARE ALSO NOTIFIED that the Board will hold an initial conference on August 26, 2021 at 2:15 p.m. HST, via interactive conference technology. You may contact the Board at (808) 586-8600 or dlir.appealsboard@hawaii.gov for a copy of the Board’s Notice of Intent to Bifurcate Case and Notice of Initial Conference.
YOU ARE FURTHER NOTIFIED that the Board intends to dismiss the appeal(s) and/or impose other sanctions as appropriate if Appellant(s) or Cross-Appellant, or their representative(s), fails to timely appear for the initial conference.
