NOTICE OF VIRTUAL PUBLIC HEARING As part of the response to the threat of COVID-19, Governor David Ige issued a Thirteenth Supplementary Proclamation dated September 22, 2020. Chapter 91, Hawaii Revised Statutes (“HRS”), administrative procedure, to the extent necessary such that, at the sole discretion of the department or agency, any administrative hearing may be conducted by telephone or video conference without the parties, department or agency, being physically present in the same location; any deadlines may be waived or suspended; and any administrative hearing procedures, such as, but not limited to, conferences, filing of documents, or service, may be done via telephone or email. Pursuant to Chapter 91, Hawaii Revised Statutes, notice is hereby given that the Hawaii State Department of Education (“DOE”), on behalf of the Hawaii State Board of Education (“BOE”), will hold a virtual public hearing to hear all persons interested in the proposal to amend Chapter 27 under Title 8, Hawaii Administrative Rules (“HAR”): 1. Proposal to amend Chapter 8-27, HAR, Transportation of Students, to make it consistent with the Individuals with Disabilities Education Improvement Act of 2004 (IDEA) by ensuring that transportation shall be provided to eligible students with disabilities who attend a public charter school if such transportation is required as a related service in accordance with the student’s Individualized Education Program or Section 504 Plan; 2. Proposal to amend Chapter 8-27, HAR, Transportation of Students, to make the annual effective date for parent mileage reimbursement consistent with the Internal Revenue Service effective date of January rather than July; and 3. Proposal to make various housekeeping amendments.
