NOTICE OF APPLICATION FOR VARIANCE
RECEIVED BY THE
DEPARTMENT OF HEALTH
STATE OF HAWAII

Pursuant to Hawaii Administrative Rules, Chapter 11-46, the State of Hawaii Department of Transportation (HDOT) Highways Office at 601 Kamokila Boulevard, Room #609, Kapolei, Hawaii 96707, seeks written comments from interested persons regarding the following variance application:

HDOT Highways has applied to the Department of Health for a variance from Hawaii Administrative Rules, Chapter 11-46, Section 11-46-6(a), which states, "General Prohibition. Without a permit or variance issued pursuant to section 11-46-7 or 11-46-8, no person within the State shall operate, from any premises or land owned, rented, leased, occupied, or controlled by that person, any excessive noise source."

HDOT Highways is proposing roadway resurfacing, roadway reconstruction and, replacement of existing pavement markings on the H-1 Freeway from the vicinity of Waipahu Street Overpass to Pearl City Viaduct and for connecting on-ramps and
off-ramps.

HDOT Highways would like to conduct construction related activities all day on Sunday (12:01 a.m. – midnight), Monday night through Friday (12:01 a.m. to
7:00 a.m. and 6:00 p.m. to midnight), and Saturday (12:01 a.m. to 9:00 a.m. and 6:00 p.m. to midnight) from July 2026 until July 2028.
