NOTICE OF PUBLIC HEARING
MAUI PLANNING COMMISSION
The Maui Planning Commission of the County of Maui hereby gives notice of a public hearing on February 24, 2026, commencing at 9:00 a.m., or as soon thereafter as is practicable either at the Planning Department Conference Room, Kalana Pakui Building, 250 South High Street, Wailuku, Maui, Hawai’i 96793 and also via a videoconferencing platform, on the following matter:
PUBLIC HEARINGS
1. A BILL FOR AN ORDINANCE AMENDING TITLE 19 OF THE MAUI COUNTY CODE TO ALLOW FOR AT LEAST TWO ACCESSORY DWELLING UNITS ON RESIDENTIALLY ZONED LOTS
Ms. Kate L.K. Blystone, Planning Director, referring to the Maui Planning Commission, a proposed bill amending various sections within Maui County Code Title 19 – Zoning. The proposed bill initiated by the County Council through Resolution No. 25-203 would allow at least two accessory dwelling units on residentially zoned lots. The proposed bill’s intent is to comply with State Act 39 (2024), which requires counties to adopt or amend their ordinances by December 31, 2026 to allow at least two accessory dwelling units on residentially zoned lots, subject to certain restrictions. 2. A BILL FOR AN ORDINANCE AMENDING TITLE 19 OF THE MAUI COUNTY CODE ESTABLISHING NEW H-3 AND H-4 HOTEL ZONING DISTRICTS
Ms. Kate L.K. Blystone, Planning Director, referring to the Maui Planning Commission, a proposed bill amending Section 19.06.010 and various sections within Chapter 19.14, Maui County Code. The proposed bill initiated by County Council through Resolution No. 25-230, FD1, would establish two new Hotel Zoning Districts entitled H-3 and H-4. As proposed, these new Districts would allow existing A-1 and A-2 Apartment District properties affected by Ordinance 5909 (Bill 9, CD1, FD1) to continue transient vacation rental use provided that subsequent land use changes are approved for said properties to one of the new H-3 or H-4 Districts. The proposed bill provides for uses and development standards in the new H-3 and H-4 Zoning Districts that are the same as those currently found in the existing A-1 and A-2 Apartment Zoning Districts. The subject public hearing will be conducted in accordance with Hawai’i Revised Statute Chapter 91, the Maui County Code and Rules of the Maui Planning Commission. Information pertaining to the subject applications may be obtained from the Maui County Planning Department, 2200 Main Street, Suite 315, Wailuku, Maui or by email at planning@mauicounty.gov.
Petitions to intervene shall be in conformity with Section 12-201-20 of the Rules of Practice and Procedure for the Maui Planning Commission and shall be filed with the Commission and served upon the applicant no less than ten (10) days before the first public hearing date. Filing of all documents to the Commission is c/o the Maui Planning Department, 2200 Main Street, Suite 315, Wailuku, Maui, Hawai’i 96793. The deadline for the filing of a timely petition to intervene if the first public hearing date is on February 24, 2026, is February 9, 2026.
All testimony regarding the subject applications may be filed prior to the date of the hearing by providing 15 copies of said written testimony to the Department of Planning by mail at: Planning Department, 2200 Main Street, Suite 315, Wailuku, Hawai’i 96793 or online via the Dropbox links posted below each item above. Written testimony should be submitted two business days prior to the public hearing to ensure distribution to the commissioners; however, testimony submitted after such date will still be accepted by the Board until the closing of public testimony at the hearing. Further information will be provided on the posted meeting agenda.
Any person requesting accommodations due to disabilities must call (808) 270-7735 at least three days before the date of the scheduled public hearing. For requests received sooner than three days prior to the hearing, every attempt will be made to accommodate the request, but it cannot be guaranteed.
