NOTICE OF PUBLIC HEARING
LANA’I PLANNING COMMISSION

The Lana’i Planning Commission of the County of Maui hereby provides notice of a public hearing on February 18, 2026 commencing at 5:00 p.m., or as soon thereafter as is practicable either via a videoconferencing platform, or at the Current Planning Division’s Conference Room, One Main Plaza, 2200 Main Street, Suite 619, Wailuku, Hawaii, 96793, and a courtesy testimony site at the Maui County Council, Lana’i District Office, 814 Fraser Avenue (entrance on Gay Street), Lana’i City, Hawaii, 96763 on the following matters (Final location will be set on the meeting agenda):

1. Proposed amendments to TITLE MC-12, DEPARTMENT OF PLANNING, SUBTITLE 02, LANA’I PLANNING COMMISSION, CHAPTER 402, SPECIAL MANAGEMENT AREA RULES.

The proposed rule amendments are summarized as follows:

Section 12-402-4 Definitions. The defined term, “Proposed action” is removed and the term “Development” is added, defined as any of the uses, activities, or operations on land or in or under water within a special management area as defined by Section 205A-22, Hawaii Revised Statutes, as amended.

Section 12-402-12 Assessment and determination procedures. Within the special management area, all proposed action as defined in Section 12-402-4 under development shall be subject to an assessment and a determination by the director.

Section 12-402-14, Special management area minor permit procedures. Proposed action within the Special Management Area recommended to be issued a minor permit shall be reviewed by the Lana’i Planning Commission for final determination and decision within 60 calendar days after the application is heard by the commission and public comments have been received. If the commission does not make a determination within 60 calendar days, the proposed action shall be deemed approved with a minor permit.

2. A BILL FOR AN ORDINANCE AMENDING TITLE 19 OF THE MAUI COUNTY CODE TO ALLOW FOR AT LEAST TWO ACCESSORY DWELLING UNITS ON RESIDENTIALLY ZONED LOTS

Ms. Kate L.K. Blystone, Planning Director, referring to the Lana’i, Maui and Moloka’i Planning Commissions, a proposed bill amending various sections within Maui County Code Title 19 – Zoning. The proposed bill initiated by the County Council through Resolution No. 25-203 would allow at least two accessory dwelling units on residentially zoned lots. The proposed bill’s intent is to comply with State Act 39 (2024), which requires counties to adopt or amend their ordinances by December 31, 2026, to allow at least two accessory dwelling units on residentially zoned lots, subject to certain restrictions. The subject public hearings will be conducted in accordance with the Hawaii Revised Statutes, the Maui County Code, and Rules of the Lana’i Planning Commission. Information pertaining to the subject matter may be obtained from the Maui County Planning Department, 2200 Main Street, Suite 315, Wailuku, Maui, or planning@co.maui.hi.us if offices are closed to the public. Copies of the subject matters will be mailed to any interested person who requests a copy and pays the required fees for copying and postage.

All testimony regarding the subject matters may be filed prior to the date of the hearing by providing 15 copies of said written testimony to the Department Planning or may be presented at said hearing if the hearing is not closed to the public. Written testimony may be submitted by mail to: Planning Department, 2200 Main Street, Suite 315, Wailuku, Maui, Hawaii 96793 or online via the Dropbox links posted below each item on the posted agenda. Written testimony should be submitted two business days prior to the public hearings to ensure distribution to the commissioners; however, testimony submitted after such date will still be accepted by the Commission until the closing of public testimony at the hearing. Further information will be provided on the posted meeting agenda.
