NOTICE TO BUSINESSES THAT STORE, USE, OR MANUFACTURE ANY HAZARDOUS SUBSTANCE

Hawaii Revised Statutes, (HRS), Hawaii Emergency Planning and Community Right-To-Know Act (HEPCRA), Section 128E-6(2), mandates that an owner or operator of a facility in our State that stores, uses, or manufactures hazardous substances may be required to submit a completed Tier II Chemical Inventory Report Form and a filing fee payment by March 1, 2026, to the Department of Health.

In addition, effective December 12, 2025, pursuant to applicability provisions of section 11-453-16, Hawaii Administrative Rules (HAR), an owner or operator of a facility that stores, uses or manufactures Lithium-ion batteries with a threshold quantity of 10,000 pounds or more, be subject to the emergency planning requirements of section 11-453-17, HAR. It is advised that a Tier II report be filed; there is no filing fee required.
