NOTICE OF PUBLIC HEARING ON PROPOSED AMENDMENTS TO
THE RULES AND REGULATIONS GOVERNING THE ADMINISTRATION OF
CHAPTER 7A, KAUA’I COUNTY CODE, PERTAINING TO THE HOUSING POLICY
FOR THE COUNTY OF KAUA’I, PRIMARILY RELATING TO HAWAII REVISED STATUS SECTION 201H AFFORDABLE HOUSING PROJECTS

Pursuant to Section 91-3, Hawai’i Revised Statutes, notice is hereby given that the Housing Agency for the County of Kaua’i will hold a public hearing on September 23, 2025, at 9:00 a.m., or soon thereafter, at the Lihu’e Civic Center, Pi’ikoi Building, Meeting Room, 4444 Rice Street, Lihu’e, Kaua’i, Hawai’i on the proposed amendments to the Rules and Regulations Governing the administration of Chapter 7A, Kaua’i County Code, Pertaining to the Housing Policy.

The Housing Agency proposes to amend its existing Rules and Regulations governing the administration of Chapter 7A, Kaua’i County Code, pertaining to the housing policy for the County of Kaua’i by: 1) aligning definitions with statutory changes implemented by Ordinance 1081 in October of 2020; and 2) amending provisions relating to Hawaii Revised Status Section 201H exemption projects by: a) clarifying Developer obligations; b) making clear that Developers utilizing the program will be required to enter into binding contractual agreements with the County; c) expanding upon the definition of “qualified developer” and a Developer’s obligations with regard to satisfying this requirement; and d) shifting some of the administrative burden of consulting with relevant state and county agencies to participating Developers utilizing the program.

All interested persons who wish to present their testimony may do so at the public hearing. Written testimony prior to the hearing would be appreciated. Written testimony may be submitted to the Housing Agency by mail or to 4444 Rice Street, Suite 330, Lihu’e, Kaua’i, Hawai’i, or via e-mail to housing@kauai.gov. The proposed amendment may be found on the Housing Agency’s website at https://www.kauai.gov/Government/Departments-Agencies/Housing-Agency. Hard copies of the proposed amendments are available at the Housing Agency in the Lihu’e Civic Center, Pi`ikoi Building, 4444 Rice Street, Suite 330, Lihu’e, Kaua’i, Hawai’i, during normal business hours.

A copy of the proposed amendments will be mailed to any interested person who calls the Housing Agency at 241-4444 or mails a request to the Housing Agency at 4444 Rice Street, Suite 330, Lihu’e, HI 96766, giving his or her name and address.
