Notice of Intent to File an Extension of Time to Submit Applications to Use Passenger Facility Charge (PFC) Revenue
The State of Hawaii (“State”) is posting this public notice as part of the PFC application process under the provisions of Title 49 United States Code Section 40117 and Title 14 Code of Federal Regulations Part 158 (14 CFR Part 158). As part of this process, the State invites public comment on its intent to file an extension of time to submit applications to use PFC revenue at Kahului Airport (OGG) and Ellison Onizuka Kona International Airport at Keahole (KOA).
The projects (Federal Inspection Service Building – Aircraft Parking Apron, KOA and Holdroom and Gate Improvements, OGG) were previously approved by the Federal Aviation Administration (FAA) for impose authority at Daniel K. Inouye International Airport (HNL), OGG, KOA, Lihue Airport (LIH), and Hilo International Airport (ITO) in a Final Agency Decision (FAD) dated May 18, 2022 for PFC Application Nos. 22 09-C-00-HNL, 22-09-C-00-OGG, 22-09-C-00-KOA, 22-09-C-00-LIH, and 22-07-C-00-ITO. The Federal Inspection Service Building – Aircraft Parking Apron, KOA project is substantially complete with the exception of the punch list and Change Order work items. The Holdroom and Gate Improvements, OGG project is under construction. The amount of PFC revenue for both projects approved by the FAA for impose authority is $9,726,512 and $54,868,522, respectively.
In accordance with Section 158.33 of the 14 CFR Part 158, applications for authority to use PFC revenue for these projects are required to be submitted to the FAA by May 18, 2025, which is three years after the FAA’s issued FAD. The applications to use PFC revenue must include the Airport Layout Plans (ALPs) for the airports that the projects are located in. The completion of the ALPs will require additional time beyond the application submittal deadline, therefore, the State intends to file an extension of time to submit the applications by May 18, 2027.
Currently, the State is preparing the OGG and KOA ALPs for FAA review and approval. Concurrently, the State is preparing the air carrier consultation notice and the public notice for comment as part of the application process to use PFC revenue. The State anticipates the applications for authority to use PFC revenue will be submitted to FAA by December 15, 2026.
