TO: THE HEIRS, PERSONAL REPRESENTATIVE OR ASSIGNS OF WINIFRED G. REED; THE HEIRS, PERSONAL REPRESENTATIVE OR ASSIGNS OF FRANKLIN F. PAO; DOE DEFENDANTS 1-50

You are hereby notified that the State of Hawai’i, by its Attorney General, the Plaintiff herein, has commenced proceedings in eminent domain against you in the above-entitled Court, Civil No. 1CCV-20-0000987, and has prayed that this Court vest in the Plaintiff, title to the following property located at Kaipapau, District of Koolauloa, City and County of Honolulu, State of Hawaii: Parcel 3 (Rev. 1), together with any and all abutters’ rights of vehicle access in fee simple absolute, free and clear of all liens and encumbrances; Maintenance Easement 4, a perpetual non-exclusive maintenance easement; and the temporary use and occupancy of Construction Parcel C-5 (rev. 2), including any and all improvements thereon and appurtenances thereunto belonging, except for that Land Court Order No. 24192 dated May 3, 1965, clarifying the easement held by the State of Hawaii for the free flowage of water and as to Construction Parcel C-5 (rev. 2), except for that Land Court Order dated September 24, 1964 designating Easement “E,” for the public use of the construction, preservation, and protection of a public highway, to wit: Kamehameha Highway, Replacement of Kaipapau Stream Bridge, Federal Aid Project No. BR-083-1(48) at Kaipapau, Koolauloa, Island of Oahu, Hawaii.

YOU ARE HEREBY SUMMONED and required to appear in the courtroom of the Honorable Karin L. Holma, Kaahumanu Hale, 777 Punchbowl St. Honolulu, Hawaii 96813 on Tuesday, the 15th day of October 2024 at 9:00 a.m. of said day, or to file an answer or other pleading and serve it before said day upon Plaintiff’s attorneys Patrick K. Kelly and Stuart N. Fujioka whose address is 300 Kekuanao’a Building, 465 South King St. Honolulu, Hawaii 96813. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Second Amended Complaint.
