NOTICE IS HEREBY GIVEN of the following matters to be considered by the Windward Planning Commission of the County of Hawaii in accordance with the provisions of Chapters 91 and 92, Hawaii Revised Statutes, Section 6-7.5(a) of the Charter of the County of Hawaii and Planning Commission Rules of Practice and Procedure.

Public Participation: This is an in-person meeting, and the Windward Planning Commissioners will participate in person. Submitting Written Testimony: To ensure timely delivery to Commissioners prior to the meeting, written testimony must be submitted no later than 4:30 p.m. on Wednesday June 26, 2024, by: (1) email to WPCtestimony@hawaiicounty.gov; (2) mail to the Windward Planning Commission at 101 Pauahi Street, Suite 3, Hilo, Hawaii or (3) drop-off at the Planning Department offices in Hilo at the address above or Kona at 74-5044 Ane Keohokalole Highway, Building E, 2nd Floor, Kailua-Kona, Hawaii. All written testimony, regardless of time of receipt, will be made part of the permanent record. Please submit separate testimony for each item.

APPROVAL OF MINUTES
Review and Approval of May 2, 2024 continued meeting, May 6, 2024 and June 6, 2024 Windward Planning Commission Minutes.

NEW BUSINESS
1. HOPE DIA-MEND MINISTRIES CORPORATION (PL-SPP-2023-000058)
Application for a Special Permit to establish a temporary and permanent church and related improvements on a 1-acre property within the State Land Use Agricultural District. The subject property is located at 92-8988 Ginger Blossom Lane, approximately 300 feet south of its intersection with Sea Breeze Parkway, Hawaiian Ocean View Estates, Ocean View, Kau, Hawaii, TMK: (3) 9-2-008:019.

INITIATOR: COUNTY COUNCIL (PL-CCI-2024-000007)
Bill 134, Draft 2, an ordinance amending Chapter 25 (Zoning), Article 2, Section 25-2-42, of the Hawaii County Code 1983 (2016 Edition, as amended), relating to amendments initiated by property owners and other persons. Establishes the requirement for the Planning Director to prepare a report identifying all buildings, excluding existing buildings, that are legally permitted to be constructed on surrounding properties within a one-quarter mile radius of a subject property that is seeking a change of zoning district.

INITIATOR: COUNTY COUNCIL (PL-CCI-2024-000008)
Bill 144, an ordinance amending Chapter 4 (Animals) and Chapter 25 (Zoning) of the Hawaii County Code 1983 (2016 Edition, as amended), relating to apiaries and beekeeping. Establishes accepted apiary management practices for sound and sustainable beekeeping practice, and adding apiaries to the list of allowable uses in various zoning districts.
4. PLANNING COMMISSION TRAINING
Training for the Windward Planning Commission’s members by Commission’s Attorney regarding the Commission’s powers, duties, privileges, immunities, and liabilities as it relates to Sunshine Law (Chapter 92, Hawaii Revised Statutes), Robert’s Rules of Order, and Planning Commission Rules of Practice and Procedure. This training is expected to occur in executive session in accordance with Chapter 92-5(a)(4), Hawaii Revised Statutes, as amended, and is being delivered in response to requests for legal guidance from Commissioners.
EXECUTIVE SESSION
With reference to the agenda items listed, one or more executive meetings may be anticipated. The Commission may convene an executive meeting pursuant to Chapter 92-5(a)(4), Hawaii Revised Statutes, as amended, for the purpose of consulting with the Commission’s attorney on questions and issues pertaining to the Commission’s powers, duties, privileges, immunities, and liabilities. Pursuant to Chapter 92-4, Hawaii Revised Statutes, as amended, and Rule 1-5(e), Planning Commission Rules of Practice and Procedure, an affirmative 2/3rds vote of the members present is necessary to hold an executive meeting.
PLANNING DIRECTOR’S REPORT
Report on Special Management Area (SMA) determinations and minor permits issued by the Planning Director for June 2024.
AGENDA ITEMS FOR NEXT MEETING
The Commissioners will comment on matters not on the current agenda, for consideration for the Commission’s next meeting.
ANNOUNCEMENTS
The Windward Planning Commission’s next regular meeting is scheduled for Thursday, August 1, 2024 at the County Council Chambers in Hilo and the public can also testify via Zoom. The date and venue of the meeting are subject to change.
