PUBLIC HEARING NOTICE

NOTICE IS HEREBY GIVEN of a public hearing to be held by the Department of Planning and Permitting (“DPP” or “department”) of the City and County of Honolulu, pursuant to §91-3 and §92-41 Hawaii Revised Statute (“HRS”) for the purpose of 1) Adopting Title 20 DPP Administrative Rules, Chapter 30, Self-Certification; and 2) Repealing the DPP Part 2 Rules Relating to Shoreline Setbacks and the Special Management Area and replacing them with Title 20 DPP Administrative Rules, Chapter 31, Shoreline Setbacks and the Special Management Area. The hearing will be held at the following time and location:

The purpose of the hearing is to adopt the proposed Title 20, DPP Administrative Rules, Chapter 30 Self-Certification Rules, and Chapter 31, Shoreline Setbacks and the Special Management Area, hereinafter referred to as “Rules.”

Chapter 30 of the Rules will govern Self-Certification practices under Ordinance No. 23-29, relating to Professional Self-Certification. The details of the proposed Chapter 30 Rules are as follows:

Subchapter 1 General Provisions, the purpose, scope, conflict and definitions;
Subchapter 2 Requirements for Self Certification, the registration requirements; the training requirements; the qualifications requirements; the procedures for the application for registration and renewal of the certificate of registration; the administrative action to suspend, terminate, and the action to reinstate the certificate;
Subchapter 3 Applications Processed Under the Self-Certification Program, the requirements for the self-certified plans, building permit application submittal, permit processing, and effects of permit approval; and
Subchapter 4, Appeals – Contested Case Hearings, the procedures to appeal the Director’s actions and provisions regarding approvals.

Chapter 31 of the Rules for Shoreline Setbacks and the Special Management Area will implement Hawaii Revised Statutes Chapter 205A and Revised Ordinances of Honolulu Chapters 25 and 26. The existing DPP Part 2 Rules Relating to Shoreline Setbacks and the Special Management Area will be repealed and replaced with Title 20 Chapter 31, which will reflect the amendments adopted under Ordinances 23-3 and 23-4. The details of the proposed Chapter 31 Rules are as follows:

Subchapter 1 General Provisions, the purpose, definitions, testimony and declaratory rulings;
Subchapter 2 Special Management Area, permit determinations and project valuations;
Subchapter 3 Shoreline Setback Lines, determining the shoreline setback line and setback area, alternative erosion rate methodology, reduced shoreline setback area, certified shoreline survey requirements and waivers;
Subchapter 4 Mapping and Marking the Regulatory Shoreline and Shoreline Setback Line, applications on shoreline lots and marking the shoreline during construction;
Subchapter 5 Minor Structures and Activities in the Shoreline Setback, requirements for Director’s approval, and application requirements;
Subchapter 6 Nonconforming Structures in the Shoreline Setback, repair and alteration, and valuations;
Subchapter 7 Shoreline Setback Variances, compliance with HRS Chapter 343, application requirements and processing, decision, reapplication, revocation, modification, and reconsideration; and
Subchapter 8 Contested Case Hearings, the procedures to appeal the Director’s actions.

Fasi Municipal Building, 650 South King Street, Honolulu, Hawaii 96813, during normal business hours (7:45 a.m. to 4:30 p.m., Monday thru Friday). Please call 808-768-8000 to request mailing of rules, which shall be subject to payment or copying and postage fees.

All interested persons are invited to attend and submit data, views or arguments with respect to the proposed rules, either orally or in writing. All written and oral submissions will be fully considered. Those persons desiring to testify may register prior to the public hearing at the public hearing site and are encouraged to submit one copy of their testimony in writing.

Attendance at the public hearing is not necessary to submit testimony. Written testimony, data, views or arguments with respect to the proposed amendments to the Rules may be faxed (808-768-6743) or mailed (650 South King Street,
7th Floor, Honolulu, Hawaii 96813) to the Department prior to the public hearing and will be considered in the evaluation of the request.
