NOTICE

The Council of the City and County of Honolulu at its meeting held on December 6, 2023, laid over and ordered published the following Resolution. Pursuant to Section 3-202.9 of the Revised Charter of the City and County of Honolulu 1973, as amended, the Honolulu City Council hereby gives notice that the following Resolution authorizing proceedings in eminent domain has been introduced and is under its consideration:

RESOLUTION 23-227 (FOR CONDEMNATION) PROVIDING FOR THE ACQUISITION OF LAND FOR PUBLIC USE OF 1421 PENSACOLA STREET, LOCATED AT KULAOKAHUA, HONOLULU, OAHU, HAWAII, AND DETERMINING AND DECLARING THE NECESSITY OF THE ACQUISITION BY EMINENT DOMAIN.

I.

The valid public use and purpose for the acquisition of land is to develop affordable housing in Honolulu. An eminent domain lawsuit shall be filed to acquire the land, in fee simple, identified as 1421 Pensacola Street, Parcel 1 (TMK: 2-4-019-048), located at Kulaokahua, Honolulu, Oahu, Hawaii, and more particularly described in the legal descriptions and map in the attached Exhibit A. The Corporation Counsel of the City and County of Honolulu is hereby authorized to file the eminent domain lawsuit.

Eminent Domain is necessary for the public use and purpose described above.
