NOTICE OF A PUBLIC HEARING FOR RULEMAKING
PROPOSED AMENDMENT OF PLANNING DEPARTMENT RULE 11
COUNTY OF HAWAII PLANNING DEPARTMENT RULES OF PRACTICE AND PROCEDURE

NOTICE IS HEREBY GIVEN of a public hearing for the proposed amendment of
Rule 11 (Shoreline Setback) of the Planning Department Rules of Practice and Procedure, which is initiated by the Planning Director, pursuant to Chapter 91, Hawaii Revised Statutes (HRS) and Planning Department Rule 2.

Keohokalole Highway, Building E, 2nd Floor, Kailua-Kona, Hawaii.
Public Participation: This is an in-person meeting. The primary way to view or testify at this meeting is in-person; however, as a courtesy to the public, the Planning Department provides the following additional ways to view or testify remotely at this meeting.

The proposed rulemaking to the County of Hawaii Planning Department’s Rules of Practice and Procedure are to amend Rule 11, regarding the Shoreline Setback Area to conform with Act 16, which amended Chapter 205A, Hawaii Revised Statutes (HRS) regarding the Special Management Area and Shoreline Setbacks. The proposed amendments to PD Rule 11 seek to add sea level rise to the definition of coastal hazards, adds a definition of beach to enhance beach protection, restricts construction of shoreline hardening structures at sites with beaches, and increases the minimum shoreline setback from 20 feet to 40 feet.
Copies of the proposed rule amendment is on file and open to view during office hours at the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii and at the Kona office of the Planning Department, West Hawaii Civic Center, 74-5044 Ane Keohokalole Highway, Building E, 2nd Floor, Kailua-Kona, Hawaii. The purpose of the public hearing is to afford all interested persons a reasonable opportunity to provide comments on the proposed changes to the rules. Comments may be presented orally at the public hearing or submitted in writing electronically to the Planning Department via email at
