NOTICE
The Council of the City and County of Honolulu at its meeting held on October 4, 2023, laid over and ordered published the following Resolution. Pursuant to Section 3-202.9 of the Revised Charter of the City and County of Honolulu 1973, as amended, the Honolulu City Council hereby gives notice that the following Resolution authorizing proceedings in eminent domain has been introduced and is under its consideration:
RESOLUTION 23-202 (FOR CONDEMNATION) PROVIDING FOR THE ACQUISITION OF EASEMENTS FOR PUBLIC USE FOR THE ROCK SLIDE MITIGATIVE IMPROVEMENTS IN THE VICINITY OF PACIFIC HEIGHTS ROAD SITE 070G, LOCATED AT KEWALO, PAUOA, HONOLULU, OAHU, HAWAII, AND DETERMINING AND DECLARING THE NECESSITY OF THE ACQUISITION BY EMINENT DOMAIN.
I.
The valid public use and purpose for the acquisition of easements is for improvements to mitigate rock fall hazards on City property in the vicinity of Pacific Heights Road Site 0700. An eminent domain lawsuit shall be filed to acquire subsurface rock slide mitigation easements identified as Parcels 1 (TMK: 2-2-023: 055) and 2 (TMK: 2-2-023: 008), located at Kewalo, Pauoa, Honolulu, Oahu, Hawaii, and more particularly described in the legal descriptions and maps in the attached Exhibit A. The Corporation Counsel of the City and County of Honolulu is hereby authorized to file the eminent domain lawsuit,
Eminent Domain is necessary for the public use and purpose described above.
