NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Liquor Commission of the City and County of Honolulu, pursuant to the provisions of Chapter 91, Hawaii Revised Statutes, as amended, will hold a public hearing at the office of the Liquor Commission on the sixth floor of the Pacific Park Plaza building, 711 Kapiolani Boulevard, Honolulu, Hawaii, 96813, on Thursday, February 10, 2022, at 4:00 p.m., to consider the adoption of new Rules of the Liquor Commission of the City and County of Honolulu.

The existing Rules for Title 3 Department of Budget and Fiscal Services, Subtitle 6 Liquor Commission, Rules of the Liquor Commission of the City and County of Honolulu, State of Hawaii, Chapters 80-86, are proposed for repeal in their entirety, to be replaced by new Rules identified as follows, promulgated by the Liquor Commission, City and County of Honolulu:

Part I. Chapter 80.1, General Provisions
Part II. Chapter 81.1, Liquor Commissions
Part III. Chapter 82.1, Licenses and Permits, General Provisions
Part IV. Chapter 83.1, Procedure for Obtaining License
Part V. Chapter 84.1, Duties of and Supervision Over Licensee
Part VI. Chapter 85.1, Revocation of License
Part VII. Chapter 86.1, General Violations and Prosecutions

Pursuant to the Emergency Proclamation Related to the COVID-19 Response issued by Governor David Ige on November 29, 2021, relating to the COVID-19 pandemic (Proclamation), in order to allow public participation in a manner consistent with social distancing practices the following procedures are in effect for the February 10, 2022 meeting. The procedures have been modified to comply with Mayor Blangiardi’s Emergency Order No. 2021-16, executed on November 23, 2021. In accordance with concern for public health and safety, in-person testimony in the hearings room has been cancelled until further notice. Please see the instructions below on how to submit oral testimony or how to make an appearance on the proposed new Rules.

VIEWING THE MEETING AND RESTRICTIONS ON ENTRY

No members of the public will be allowed into the hearings room, but may listen to the meeting on a live broadcast. The meeting may be heard by internet live streaming through https://us06web.zoom.us/j/82446076106; by dialing 1-408-638-0968, entering the meeting ID#: 824 4607 6106#; or, the preferred method, via the Liquor Commission website event calendar at
http://www.honolulu.gov/liq/event-calendar/. You may pre-register to attend this meeting.

To provide the public with the best opportunity to observe the meeting, it is required to “mute” your device’s microphone to prevent technological difficulties.

All persons who attend the meeting must make your appearance by joining the meeting on the Zoom platform as described above. Please be aware that joining the meeting will involve entering the meeting number and completing a registration process so please allow sufficient time for this task. For testifiers who are not able to access the Zoom platform, you may attend in person in Suite 600. While in Suite 600, all Social Distancing Requirements set forth in the Proclamation and the Emergency Order must be strictly observed.

ORAL TESTIMONY

Oral testimony will be permitted on the proposed new Rules subject to the following restrictions:

1. All oral testimony must be submitted remotely through the Zoom platform.
2. Each speaker is limited to a three-minute presentation.

WRITTEN TESTIMONY

Written testimony is strongly encouraged and may be submitted to the Commission three (3) business days prior to the date of the meeting as follows:

Attendance at the public hearing is not a prerequisite for submission of testimony. Written testimony will not be accepted in person at the meeting. Written testimony that is received by 4:30 p.m., Wednesday, February 9, 2022, at the above address by hand delivery, mail, fax, or email will be included with the record of the hearing.

A copy of the proposed new Rules will be mailed at no cost to persons who call (808) 768-7333 and provide their name and mailing address. Copies are also available at no cost and may be reviewed in person at the Liquor Commission offices, Pacific Park Plaza building, 711 Kapiolani Boulevard, Suite 600, Honolulu, Hawaii, Monday through Friday between 7:45 a.m. and 4:30 p.m., and on the Liquor Commission website at http://www.honolulu.gov/liq/default.html (news and announcements).
