PUBLIC HEARING NOTICE

NOTICE IS HEREBY GIVEN of a public hearing to be held by the Department of Planning and Permitting of the City and County of Honolulu (“DPP”) for the purpose of adopting Rules and Regulations Governing General Excise Tax Exemptions. The hearing will be held at the following time and location:

Time: 10:30 a.m.
Place: Remote Meeting and In-Person Meeting at Mission Memorial Auditorium, Mission Memorial Building, 550 South King Street, Honolulu, Hawaii, 96813

Pursuant to the Emergency Proclamation Related to the COVID-19 Response issued by Governor David Ige on November 29, 2021, relating to the COVID-19 pandemic (Proclamation), in order to allow public participation in a manner consistent with social distancing practices the following procedures are in effect for the January 18, 2022 meeting. The procedures have been modified to comply with Mayor Blangiardi’s Emergency Order No. 2021-16, executed on November 23, 2021. The public may participate in the public hearing via the online meeting venue (details below).

PURPOSE:

The purpose of this public hearing is to adopt Rules Governing General Excise Tax Exemptions (“Rules”) pursuant to Revised Charter of Honolulu
§§ 4-105.4 and 6-1503, and Hawaii Revised Statutes (“HRS”) §§ 46-15.1, 201H-36 and 237-29. The rules are intended to allow the City to approve and certify for exemption from general excise taxes any qualified person or firm involved with a newly constructed, or a moderately or substantially rehabilitated housing project.

The DPP previously held a hearing on the Rules on October 29, 2021 at the above location. Having considered the Rules, testimony provided, and additional internal review, the DPP has further amended the proposed Rules by including certain terms and definitions to clarify the types of income that are eligible for the General Excise Tax exemption.

Fasi Municipal Building, 650 South King Street, Honolulu, Hawaii 96813, during normal business hours (7:45 a.m. to 4:30 p.m., Monday thru Friday). In-person attendance: The City is exercising a good faith effort to provide this option only to members of the public who are unable to attend the meeting via phone or Webex. All in-person attendees and testifiers must wear a mask while on the Mission Memorial premises and must maintain six feet of distance between themselves and others or they will not be allowed in the Auditorium. (See Mayor’s Emergency Order 2020-16. Note: Subject to change.)

Attendance at the public hearing is not necessary to submit testimony. Written testimony, data, views or arguments with respect to the proposed rules may be faxed (808-768-6743) or mailed (650 South King Street, 7th Floor, Honolulu, Hawaii 96813) to the Department prior to the public hearing and will be considered in the evaluation of the request.
