PROCLAMATION By the authority vested in me as the County Clerk by the laws of the State of Hawai’i and the County of Kaua’i, I, Jade K. Fountain-Tanigawa, County Clerk, County of Kaua’i, hereby determine, designate, and proclaim as follows: WHEREAS, a vacancy in the office of Prosecuting Attorney has occurred; WHEREAS the remainder of the current term of Prosecuting Attorney is set to expire at twelve o’clock meridian on December 2, 2024; WHEREAS, pursuant to Section 9A.05, Kaua’i County Charter, the vacancy shall be filled by a Special Primary Election and a Special General Election, patterned after the primary and general election laws of the state, insofar as applicable; WHEREAS, pursuant to Section 11-41, Hawai’i Revised Statutes, notice of the sitting of the board of registration on election day to hear appeals is to occur; WHEREAS, pursuant to Section 11-91, Hawai’i Revised Statutes, a proclamation shall be issued containing a statement of the purposes for which the election is to be held, and a designation of the offices and terms for which candidates are to be nominated or elected; WHEREAS, pursuant to Section 11-92.1, Hawai’i Revised Statutes, a proclamation shall be issued containing all voter service centers and places of deposit, including the days each voter service center and place of deposit is open and the hours of operation and location of each voter service center and place of deposit, and whenever a new precinct is established in any representative district; WHEREAS, pursuant to Section 11-101, Hawai’i Revised Statutes, all elections shall be conducted by mail in accordance with Title 2, Hawai’i Revised Statutes; WHEREAS, pursuant to Section 11-103, Hawai’i Revised Statutes, public notice of the date or dates on which initial ballot packages are to be mailed shall be given; WHEREAS, pursuant to Section 11-109, Hawai’i Revised Statutes, there are specific provisions relating to the establishment and days and hours of operation of voter service centers and places of deposit; WHEREAS, pursuant to Section 11-131, Hawai’i Revised Statutes, there are specific provisions relating to the hours of voting at voter service centers that are to be read in conjunction with Section 11-109, Hawai’i Revised Statutes; NOW, THEREFORE, I, Jade K. Fountain-Tanigawa, County Clerk, County of Kaua’i, do hereby proclaim that a Special Primary Election for Prosecuting Attorney, consistent with this proclamation, will be held on Saturday, December 18, 2021, and, if necessary, that a Special General Election will be held on Saturday, February 26, 2022, between the hours of 7:00 a.m. and 7:00 p.m. in the County of Kaua’i for the purpose of filling the vacancy in the office of Prosecuting Attorney for the remainder of its current unexpired term that expires at twelve o’clock meridian on December 2, 2024. Consistent with this proclamation, I hereby declare the following: 1. CANDIDATE NOMINATION AND FILING. Candidate nomination and filing services will be offered by the Office of the County Clerk, Elections Division. Services will be offered between the hours of 7:45 a.m. and 4:30 p.m., Monday through Friday beginning on October 4, 2021 and ending at 4:30 p.m. on October 15, 2021. The Elections Division is located at: Historic County Annex 4386 Rice Street, Room 101 Li¯hu’e, Hawai’i 96766 No voter signatures will be required on nomination documents, but payment of the applicable filing fee shall be required to complete the filing process. County Board of Ethics and State Campaign Spending Commission reports must also be filed directly with the respective agencies. 2. BALLOT MAILING DATES The initial mailing of ballots shall occur on or before the dates below: Special Primary Election: November 23, 2021 Special General Election: February 1, 2022 3. VOTER SERVICE CENTERS A voter service center will be established and operated by the Office of the County Clerk, Elections Division. The voter service center will be open ten business days prior to the election and on Election Day. The days and hours of operation are: Special Primary Election: December 6, 2021 through December 17, 2021 Monday through Saturday, excluding Sundays and State Holidays 8:00 a.m. to 4:00 p.m. December 18, 2021 7:00 a.m. to 7:00 p.m. Special General Election: February 11, 2022 through February 25, 2022 Monday through Saturday, excluding Sundays and State Holidays 8:00 a.m. to 4:00 p.m. February 26, 2022 7:00 a.m. to 7:00 p.m. The services provided at the voter service centers include accessible in-person voting, same day voter registration, and collection of voted ballots. The voter service center is physically accessible or accessible through special administrative voting procedures to all eligible voters with disabilities and elderly voters. The voter service center will be located at: Historic County Annex Basement 4386 Rice Street Li¯hu’e, Hawai’i 96766 4. PLACES OF DEPOSIT Places of deposit are established and operated by the Office of the County Clerk, Elections Division. Places of deposit are established for voters to drop off their voted mail ballot packet to be collected by the County Elections Division. BOARD OF REGISTRATION The Board of Registration for the islands of Kaua’i and Ni’ihau shall sit in the office of the County Clerk or meet via remote technology from 7:00 a.m. until the close of voting, on December 18, 2021 and February 26, 2022, for the purpose of considering complaints and appeals relative to the eligibility to vote or the registration of voters for the Special Primary Election and Special General Election. 6. REPORTING OF ELECTION RESULTS BY PRECINCTS Election results will be reported by precinct. For election purposes, the County of Kaua’i consists of three state representative districts (i.e. 14th Representative District, 15th Representative District, and 16th Representative District). These districts are further divided for purpose of the Special Primary Election and the Special General Election into precincts. Specifically, the 14th Representative District is divided into five precincts (i.e. 14-01, 14-02, 14-03, 14-04, and 14-05); the 15th Representative District is divided into five precincts (i.e. 15-01, 15-02, 15-03, 15-04, and 15-05); and the 16th Representative District is divided into six precincts (i.e. 16-01, 16-02, 16-03, 16-04, 16-05, and 16-06).
