NOTICE OF PUBLIC HEARING

Pursuant to Hawaii Revised Statutes (“HRS”) section 431:2-201 and chapter 91, notice is hereby given that the Insurance Division (“Division") will hold a virtual public hearing on Thursday, September 30, 2021, at 10:30 a.m., via Microsoft Teams (link available at:
https://calendar.ehawaii.gov/calendar/meeting/67487/details.html, to hear all persons interested in the proposed amendments and compilation of Hawaii Administrative Rules (“HAR”) Chapter 16-171 entitled "Miscellaneous Insurance Rules."
The purpose of the proposed amendments to this chapter is to be consistent with amendments made to various sections of Hawaii Revised Statutes Chapter 431 by Act 111, Session Laws of Hawaii 2021. Further, the amendments will establish uniform terms and durations of licenses and registrations issued by the Insurance Division, standardize fee calculation for all licenses and registrations, and explicitly provides the insurance commissioner with the authority to mandate all holders of licenses or registrations to apply for a licensure or registration electronically through the nongovernmental entity. Amendments will be made to HAR §§16-171-301 to 324.
All interested persons shall be afforded the opportunity to submit data, views, or arguments, orally or in writing, to the Insurance Division at the time of hearing. All written and oral submissions regarding the proposed rules shall be fully considered. All persons wishing to submit written testimony are requested to submit their written testimony by Monday, September 27, 2021, to the Insurance Division at the address noted below or by emailing it to pkondo@dcca.hawaii.gov.
The full text of the proposed rules is available for review and can be downloaded free of charge from the Department of Commerce and Consumer Affairs website:
http://cca.hawaii.gov/proposed-rulemaking/. A copy of the proposed rule will be mailed to any person who requests a copy upon receipt of $7.80 for the copy and postage. Please submit your request to: Department of Commerce and Consumer Affairs, Insurance Division, 335 Merchant Street, Room 213, Honolulu, Hawaii 96813. A copy may also be obtained at the address above between 7:45 A.M. and 4:30 P.M., Monday through Friday, excluding holidays. The cost of this copy, $5.00, is due and payable at the time of pick-up. Further, the proposed rules may be reviewed in person free of charge at the Insurance Division at the address and hours of operation noted above.

pkondo@dcca.hawaii.gov or call (808) 586-2790, at least 5 working days prior to the hearing. The Insurance Division intends to make its decision on the proposed rules at the time of the hearing. However, in the event the Insurance Division decides to take the decision on the proposed rules under advisement, it will announce the date when it intends to make its decision.
