NOTICE OF PUBLIC HEARING PROPOSED ADMINISTRATIVE RULES RELATED TO ORDINANCE 1079 RESTRICTING THE USE AND SALE OF POLYSTYRENE FOAM FOOD SERVICE CONTAINERS LIHU’E The County of Kaua’i Department of Public Works will hold a public hearing on the proposed Administrative Rules related to Ordinance 1079 Restricting the Use and Sale of Polystyrene Foam Food Service Containers in the County of Kaua’i. Hearing to be held on: Tuesday, September 28, 2021 5:00 p.m. H.S.T. via the Microsoft Teams Phone number 1-469-848-0234, conference ID 319 316 482# The Department proposes to establish Administrative Rules for Ordinance 1079 which will take effect on January 1, 2022. The proposed Administrative Rules are required by Ordinance 1079 and establish processes for food providers to apply for exemptions from the polystyrene prohibition and address the duration, renewal, and revocation of such exemptions. Ordinance 1079 and the proposed Administrative Rules are available on the County’s website at www.kauai.gov/polystyreneban. Copies of the proposed Administrative Rules will be mailed to any person who requests a copy and pays the copying and postage costs. Requests for copies can be made by calling(808) 241-4837. The proposed Administrative Rules are also available at the Department in the Lihu’e Civic Center Moikeha Buidling, at 4444 Rice St., Suite 295 Lihu’e HI 96766, during normal business hours. PUBLIC COMMENTS AND TESTIMONY All persons who wish to present testimony at the public hearing may do so via the Microsoft Teams audio conferencing platform by calling 1-469-848-0234, conference ID 319 316 482# Those wishing to participate via video teleconference must utilize Microsoft Teams software. Anyone providing testimony by video teleconference must register with the Solid Waste Division at least two hours prior to the Public Hearing (on or before 3:00 p.m. H.S.T. on September 28, 2021) by sending an email to kaki@kauai.gov or by calling (808) 241-4195, and providing their name, phone number and email address. A link to the video teleconference will be emailed following registration. Written comments may also be submitted by email to solidwaste@kauai.gov or by mail to 4444 Rice St., Suite 295 Lihu’e HI 96766 at any time before midnight on September 28, 2021.
