NOTICE OF PUBLIC HEARING

Pursuant to Sections 91-3 and 92-41, Hawaii Revised Statutes, notice is hereby given that the Department of Human Services will hold a public hearing to consider the repeal of Hawaii Administrative Rules (HAR) Chapters 17-891.1, Registration of Family Child Care Homes, 17-892.1, Licensing of Group Child Centers and Group Child Care Homes, 17-895, Licensing of Infant and Toddler Child Care Centers, 17-896, Licensing of Before and After School Child Care Facilities and the adoption of proposed new chapter rules for the Benefit, Employment and Support Services Division for the purpose of streamlining and conforming to federal and state statutes. A brief description of the proposed rules is listed below:

REPEAL OF CHAPTER 17-891.1, REGISTRATION OF FAMILY CHILD CARE HOMES

Chapter 17-891.1, Hawaii Administrative Rules, entitled "Registration Of Family Child Care Homes" is proposed to be repealed.

CHAPTER 17-891.2, REGISTRATION OF FAMILY CHILD CARE HOMES

The proposed chapter 17-891.2, Registration of Family Child Care Homes, establishes the rules governing the administration and implementation of the child care block grant authorized under 42 U.S.C. §9858 and 42 U.S.C. §618.

The proposed chapter 17-891.2 provides the requirements to operate a registered family child care home and describes the application process, registration certificate, staffing, health and safety training, disaster plan and standards for health, sanitation, environmental health, physical facility and safe sleep.

REPEAL OF CHAPTER 17-892.1, LICENSING OF GROUP CHILD CARE CENTERS AND GROUP CHILD CARE HOMES

Chapter 17-892.1, Hawaii Administrative Rules, entitled "Licensing Of Group Child Care Centers and Group Child Care Homes" is proposed to be repealed.

CHAPTER 17-892.2, LICENSING OF GROUP CHILD CARE CENTERS AND GROUP CHILD CARE HOMES

The proposed chapter 17-892.2, Rules Governing Licensing Of Group Child Care Centers and Group Child Care Homes, establishes the rules governing the administration and implementation of the Child Care and Development Block Grant as authorized under 42 U.S.C. §9858 and 42 U.S.C. §618.

The proposed chapter 17-892.2 describes the requirements to operate a group child care center and group child care home, application process, license certificate, staffing, health and safety training, disaster plan and standards for health, sanitation, environmental health, and the physical facility.

REPEAL OF CHAPTER 17-895, LICENSING OF INFANT AND TODDLER CHILD CARE CENTERS

Chapter 17-895, Hawaii Administrative Rules, entitled "Licensing Of Infant And Toddler Child Care Centers" is proposed to be repealed.

CHAPTER 17-895.1, LICENSING OF INFANT AND TODDLER CHILD CARE CENTERS

The proposed chapter 17-895.1 describes the requirements to operate an infant and toddler child care center, application process, license certificate, staffing, health and safety training, disaster plan, standards for health, sanitation, environmental health, physical facility and safe sleep.

REPEAL OF CHAPTER 17-896, LICENSING OF BEFORE AND AFTER SCHOOL CHILD CARE FACILITIES

Chapter 17-896, Hawaii Administrative Rules, entitled "Licensing of Before and After School Child Care Facilities" is proposed to be repealed.

CHAPTER 17-896.1, LICENSING OF BEFORE AND AFTER SCHOOL CHILD CARE FACILITIES

The proposed chapter 17-896.1 describes the requirements to operate a before and after school child care facility, application process, license certificate, staffing, health and safety training, disaster plan, standards for health, sanitation, environmental health and physical facility.

A public hearing will be held on:

Friday, July 30, 2021, 9:30 a.m.

This will be a virtual event using Microsoft Teams.

There are two ways to participate in the public hearing: online via the internet or by telephone, or by written testimony. All interested persons are invited to attend the virtual hearing and present relevant information to state their views relative to the proposed rules either orally or in writing for the department to consider.

Online: Persons may present live video/oral testimony via internet or telephone during the online public hearing. To participate, you will need either a computer with internet access, video camera, and microphone, or a telephone. To sign up please email your request at least 48 hours in advance to: BESSD.CCPO@dhs.hawaii.gov to request the weblink to attend the virtual hearing via video conference call through Microsoft Teams. Please include your email, full name, and phone number. A confirmation will be sent to you with instructions, the meeting link, and call-in number.

Written Testimony: Should written testimony be presented, one (1) copy shall be made available to the presiding officer at the public hearing or within seven (7) days before the hearing to:

If written testimony would be provided without attending the public hearing, written testimony must be received by 4:30 pm on July 30, 2021.

Special accommodations (i.e., Sign language interpreter, large print, taped materials, or accessible parking) can be made, if requested at least five (5) working days before the scheduled public hearing on Oahu by calling (808) 586-5735. Neighbor island residents needing special accommodations should contact the Benefit, Employment and Support Services Division, Section Administration office on the respective islands with their requests.
