NOTICE

The Council of the City and County of Honolulu at its meeting held on April 14, 2021, laid over and ordered published the following Resolutions. Pursuant to Section 3-202.9 of the Revised Charter of the City and County of Honolulu 1973, as amended, the Honolulu City Council hereby gives notice that the following Resolutions authorizing proceedings in eminent domain have been introduced and are under its consideration:

RESOLUTION 21-67 (FOR CONDEMNATION) PROVIDING FOR THE ACQUISITION OF LAND FOR PUBLIC USE TO CREATE A NEIGHBORHOOD PARK ABUTTING THE PEARL HARBOR HISTORIC TRAIL, LOCATED AT WAIMALU AND KALAUAO, EWA, OAHU, HAWAII, AND DETERMINING AND DECLARING THE NECESSITY OF THE ACQUISITION BY EMINENT DOMAIN.

BE IT RESOLVED by the Council of the City and County of Honolulu:

I.

The valid public use and purpose for the acquisition of real property is for the creation of a Neighborhood Park that abuts the Pearl Harbor Historic Trail. An eminent domain lawsuit shall be filed to acquire real property, in fee simple, identified as Parcel 1 (TMK: 9-8-009-001), Parcel 2 (TMK: 9-8-009-010), and Parcel 3 (TMK: 9-8-009-008), located at Waimalu and Kalauao, Ewa, Oahu, Hawaii, and more particularly described in the legal descriptions and map attached as Exhibit A. The Acting Corporation Counsel of the City and County of Honolulu is hereby authorized to file the eminent domain lawsuit. Eminent Domain is necessary for the public use and purpose described above.

AYES: Councilmembers Cordero, Elefante, Fukunaga, Kia’aina, Say, Tsuneyoshi, Tulba, Tupola, Waters. – 9.

RESOLUTION 21-68 (FOR CONDEMNATION) PROVIDING FOR THE ACQUISITION OF EASEMENTS FOR PUBLIC USE FOR THE BERETANIA STREET SEWER IMPROVEMENTS — ARTESIAN STREET EASEMENTS, LOCATED AT PUNAHOU, HONOLULU, OAHU, HAWAII AND DETERMINING AND DECLARING THE NECESSITY OF THE ACQUISITION BY EMINENT DOMAIN.

BE IT RESOLVED by the Council of the City and County of Honolulu:

I.

The valid public use and purpose of the Beretania Street Sewer Improvements, including the acquisition of the Artesian Street Easements, Parcels 1 and 2 (TMK: 2-8-010) is for the improvement, repair, and rehabilitation of sewer lines to improve service to the residents of the area and to protect water quality, sanitation, and public health. A lawsuit for eminent domain shall be filed to acquire sewer easements over, under, through, and across Parcels 1 and 2 (TMK: 2-8-010), located at Punahou, Honolulu, Oahu, Hawaii, and more particularly described in the legal descriptions and map in the attached Exhibit A. The Acting Corporation Counsel of the City and County of Honolulu is hereby authorized to file the eminent domain lawsuit. Eminent Domain is necessary for the public use and purpose described above.
