NOTICE OF PUBLIC HEARING ON PROPOSED AMENDMENTS TO THE HAWAII ADMINISTRATIVE RULES TITLE 11, CHAPTER 60.1 AIR POLLUTION CONTROL DEPARTMENT OF HEALTH STATE OF HAWAII Docket No. 11-60.1-03-21 (CAB Docket No. 21-CA-PA-21) The State of Hawaii Department of Health, Clean Air Branch (CAB) will accept written comments and hold a public hearing on the proposed amendments of the Hawaii Administrative Rules, Title 11, Chapter 60.1 on Air Pollution Control. The proposed amendments align state regulations with updates to the U.S. Environmental Protection Agency’s regulations or directives and with rules and procedures used in other states; improve methods on handling extremely difficult issues such as open burning; and streamline our enforcement process. Changes are also proposed to improve clarity and consistency and to correct typographical errors and cross-references. The proposed amendments primarily address the following topics: Change the status of non-major Covered Source Permits to Noncovered Source Permits. Exempt nonroad engines from air permitting. Add test methods and remove director’s discretion in the determination of air violations. Improve existing regulations, or add new ones, for open burning and agricultural burning. Add new categories of field citations. The overall result of these revisions will be increased productivity, clarification and efficiency in CAB. Moreover, the proposed amendments would provide economic, and health and safety benefits to local businesses, neighborhoods, communities and some government agencies, including fire departments. The public hearing will be held at 10:00 a.m. on May 5, 2021 via Zoom. Interested parties may provide oral comments; the DOH reserves the right to impose time limits on testimony.
