PUBLIC HEARING NOTICE

NOTICE IS HEREBY GIVEN of a public hearing to be held by the Department of Planning and Permitting of the City and County of Honolulu for the purpose of adopting Rules and Regulations Governing Short Term Rentals. The hearing will be held at the following time and location:

Place: Remote Meeting and at Mission Memorial Auditorium, Mission Memorial Building, 550 South King Street, Honolulu, Hawaii, 96813

Pursuant to the Eighteenth Proclamation issued by Governor David Ige on February 12, 2021, and Mayor Blangiardi’s Emergency Order No. 2021-02, effective February 25, 2021 (Emergency Order), both relating to the COVID-19 Pandemic, in order to allow public participation in a manner consistent with social distancing practices the following procedures are in effect for the meeting. In accordance with protecting the health and welfare of the community, the April 6, 2021 meeting will be held remotely. The public may participate in the public hearing via the online meeting venue (details below).

PURPOSE:

The purpose of this public hearing is to adopt Rules and Regulations Governing Short Term Rentals pursuant to Revised Charter of Honolulu §§ 4-105.4, 6-1503, and Revised Ordinances of the City and County of Honolulu (“ROH”) §§ 21-1.30 and 21-5.730. They are intended to regulate the operation and advertising of bed and breakfast homes and transient vacation units within the City and County of Honolulu as provided in Chapter 21, ROH, also known as the Land Use Ordinance (“LUO”); to permit bed and breakfast homes and transient vacation units in certain zoning districts, with limitations; and to require a registration number be included in certain short term rental advertising.

A second purpose for this public hearing is to allow for adequate feedback from all parties being affected by this proposed Rules and Regulations Governing Short Term Rentals pursuant to Hawaii Revised Statutes Chapter 91 and Hawaii Revised Statutes Chapter 201M, the "Hawaii Small Business Regulatory Flexibility Act."

Copies of the rules relating to the Rules and Regulations Governing Short Term Rentals are available free of charge at http://www.honoluludpp.org/Home.aspx, http://www.honolulu.gov/dppstr/news-and-updates, or may be reviewed or obtained at the Department of Planning and Permitting, 7th Floor, Frank F. Fasi Municipal Building, 650 South King Street, Honolulu, Hawaii 96813, during normal business hours (7:45 a.m. to 4:30 p.m., Monday thru Friday). In-person attendance: The City is exercising a good faith effort to provide this option only to members of the public who are unable to attend the meeting via phone or Webex. All in-person attendees and testifiers must wear a mask while on the Mission Memorial premises and must maintain six feet of distance between themselves and others or they will not be allowed in the Auditorium. (See Mayor’s Emergency Order 2020-07. Note: Subject to change.)

Attendance at the public hearing is not necessary to submit testimony. Written testimony, data, views or arguments with respect to the proposed rules may be faxed (808-768-6743) or mailed (650 South King Street, 7th Floor, Honolulu, Hawaii 96813) to the Department prior to the public hearing and will be considered in the evaluation of the request.
