NOTICE OF PUBLIC HEARING
MAUI PLANNING COMMISSION
The Maui Planning Commission of the County of Maui hereby gives notice of a public hearing on October 27, 2020, commencing at 9:00 a.m., or as soon thereafter as is practicable either at the Planning Department Conference Room, 250 South High Street, Wailuku, Maui, Hawaii, 96793 or via the BlueJeans videoconferencing platform on the following matter:
SPECIAL MANAGEMENT AREA USE PERMIT
MR. WILLAM SPENCE OF WILLIAM SPENCE & ASSOCIATES, on behalf of HALE KAIOLA, LLC, requesting a Special Management Area Use Permit for the proposed construction of a 100 percent affordable 40-unit duplex project with related infrastructure improvements and amenities to include a pavilion with picnic tables and barbecue facilities, a playground, and landscaping. Four types of units are proposed with either two or three bedrooms and will range in size from approximately 731 to 1,250 square feet. Ownership will be via a condominium property regime and common elements will be governed by an association of apartment owners. The lot proposed for development is located at the corner of Kaiola Place and Ohukai Road, Kihei, Island of Maui at TMK: (2) 3 9-029:049. (SM1 2019/0009) (T. Furukawa)
The subject public hearing will be conducted in accordance with the Hawaii Revised Statutes, the Maui County Code and Rules of the Maui Planning Commission, and/or as they may be suspended by Mayoral or Gubernatorial Emergency Proclamation. Information pertaining to the subject application may be obtained from the Maui County Planning Department, 2200 Main Street, Suite 315, Wailuku, Maui, or planning@mauicounty.gov if offices are closed to the public.
Petitions to intervene shall be in conformity with Section 12-201-20 of the Rules of Practice and Procedure for the Maui Planning Commission and shall be filed with the Commission and served upon the applicant no less than ten (10) days before the first public hearing date. Filing of all documents to the Commission is c/o the Maui Planning Department, 2200 Main Street, Suite 315, Wailuku, Maui, Hawaii 96793. The deadline for the filing of a timely petition to intervene if the first public hearing date is October 27, 2020 is October 13, 2020.
All testimony regarding the application may be filed prior to the date of the hearing by providing 15 copies of said written testimony to the Department Planning if offices are open to the public, or via email if offices are closed, or may be presented at said hearing if the hearing is not closed to the public. Written testimony may be submitted by mail to: Planning Department, 2200 Main Street, Suite 315, Wailuku, Maui, Hawaii 96793, or by email to planning@mauicounty.gov. Written testimony must be received by the Planning Department by noon, one business day before the hearing to ensure distribution to the commission.
