NOTICE IS HEREBY GIVEN of a public hearing to be held by the Planning Commission of the City and County of Honolulu:

PLACE: Remote Meeting & Mission Memorial Conference Room,

Pursuant to Governor David Ige’s Tenth Supplementary Proclamation, issued on July 17, 2020; and Mayor Kirk Caldwell’s Emergency Orders 2020-22 and 2020-23, issued on July 31, 2020 and August 7, 2020, and Fifth Supplemental Proclamation of Emergency or Disaster, issued August 6, 2020, all relating to the COVID-19 Pandemic, the September 16, 2020 meeting will be held remotely to prevent transmission of the virus causing COVID-19. Protecting the health and welfare of the community is of utmost concern. Commission members, City Staff, and Applicants will participate via an online meeting venue. Information on how the public may participate in the meeting is provided below.

WAIANAE, OAHU – STATE SPECIAL USE PERMIT – 2020/SUP-4 (FK)
PVT LAND COMPANY LTD. INTEGRATED SOLID WASTE MANAGEMENT FACILITY
(ISWMF) RELOCATION PROJECT

Applicant: PVT Land Company, Ltd on behalf of Leeward Land Company, LLC

Location: Across Lualualei Naval Road from 87-2020 Farrington Highway, Nanakuli, Waianae, Oahu

Request: State Special Use Permit to relocate the PVT Land Company Ltd., ISWMF, currently located within the State Land Use Urban District, to a new site directly across Lualualei Naval Road

A copy of the State Special Use Permit application is available for viewing at the Waianae Satellite City Hall, 85-670 Farrington Highway, No. 4, 8 a.m. to 4:00 p.m. by appointment only and the Fasi Municipal Building, 650 South King Street,
7th Floor, 7:45 a.m. to 4:30 p.m.

This hearing is to be held under the provisions of Chapters 46, 92, and 205, Hawaii Revised Statutes, as amended, Articles VI and XIII, Revised Charter of the City and County of Honolulu, 1973, as amended, Sections 2-40, 2-43 and 2-44 of the Rules of the Planning Commission, City and County of Honolulu, and Chapter 15-15 of the Hawaii Administrative Rules.

The particular sections of statutes and rules involved include 205-2 and 205-4.5(7) of the Hawaii Revised Statutes, as amended, and Subchapter 4 of Chapter 2 and Section 2-45 of the Rules of the Planning Commission. The issue involved relates to whether to grant a Special Use Permit pursuant to Section 205-6, Hawaii Revised Statutes, for a waste disposal and processing facility, and accessory bio-fuel facility and solar energy facilities including support facilities that are not permitted in the State Land Use Agricultural District.

Any party may retain counsel if the party so desires, and an individual may appear on his own behalf, or a member of a partnership may represent the partnership, or an officer or authorized employee of a corporation or trust or association may represent the corporation, trust, or association.

Any person or agency wishing to intervene as a party in the proceeding shall file a petition with the Planning Commission within fourteen (14) days after this notice is published in the Honolulu Star-Advertiser. The petition must conform to the requirements of Subchapter 5 of the Rules of the Planning Commission, which are available at the Department of Planning and Permitting. A contested case hearing may be held on the matter pursuant to action by the Planning Commission to grant the petition to intervene.

Join in person: The City is exercising a good faith effort to provide this option only to members of the public who are unable to attend the meeting via phone or Webex. Only persons wearing masks that cover the nose and mouth will be allowed in the Mission Memorial Conference Room. No more than ten people will be permitted in the Mission Memorial Conference Room at a time, and all people inside the Mission Memorial Conference Room must abide by social distancing guidelines and thus maintain six feet of distance between themselves and other people. No more than ten people will be permitted to wait outside the Mission Memorial Conference Room. Any person waiting outside the Mission Memorial Conference Room for a turn to testify must abide by social distancing guidelines and wear a mask that covers his or her nose and mouth. Email or fax written testimony: Written testimony may be emailed to info@honoluludpp.org or faxed to 768-6743, and must be received by 4:30pm on Monday, September 14, 2020.

Mail written testimony: Written testimony may be mailed to the Planning Commission at 650 South King Street, 7th Floor, Honolulu, Hawaii 96813; and must be received by 4:30pm on Monday, September 14, 2020.

Oral testimony via phone or Webex: To provide oral testimony during the online meeting via phone or Webex, you must register in advance by 4:30pm on Monday, September 14, 2020, by emailing your name, phone number, and subject matter to info@honoluludpp.org

In-person oral testimony: The City is exercising a good faith effort to provide the option of in-person oral testimony only to members of the public who are unable to attend the meeting via phone or Webex. To reduce the risk of COVID-19 transmission, written testimony will not be accepted in person. Written testimony must be emailed, faxed, or mailed in advance, as explained above.
