The following application for a ground water use permit has received an objection and will therefore be the subject of a public hearing in accordance with Department of Land and Natural Resources Administrative Rules 13-171, Subchapter 3 – “Water Use Permits” and Hawaii Revised Statutes Chapter 92 Public Agency Meetings. A hearings officer will gather testimony and information on the ground water use application described below:

Written and Oral Testimony:
Any person may present oral or written testimony to provide additional information regarding this application at the public hearing. We encourage interested persons to submit written testimony in advance of the hearing. We request that written testimony be submitted not later than 48 hours prior to the hearing to ensure time so that written testimonies may be posted on the Commission on Water Resource Management website. Please submit written testimony to:

If you wish to provide live oral/video testimony during the online meeting, email your request to: dlnr.cwrm@hawaii.gov not later than 48 hours in advance, with your name, phone number, email address, and your computer identification name (check your device settings). The Commission Secretary will then provide the meeting link and other pertinent information to you.

You will be placed in a Zoom “Waiting Room”. The hearing officer will call upon you via livestream to join the meeting; prior to that please mute your microphone and turn off your own camera; during your oral testimony you will mute any livestream of the hearing.

The hearing officer will hear a staff presentation, accept testimony, and close the public hearing at the end of the hearing unless a decision to extend the hearing is made. Once closed, the testimony received at this public hearing and the staff’s recommendation will be forwarded to the Commission on Water Resource Management for its decision at a later date at a duly noticed Commission meeting. If you have a legal interest that may be adversely affected by the proposed water use, you have a right, under Hawaii Administrative Rule §13-167-52(a), to request an administrative contested case hearing. However, you must make a request for a hearing orally or in writing by the close of public hearing and you must file a written petition for a contested case hearing with the Commission within ten days (September 4, 2020) of the close of the hearing. Petition forms may be obtained by contacting the Commission’s office or from its website at: https://dlnr.hawaii.gov/cwrm/info/forms/. Any petition sent by mail must be postmarked no later than September 4, 2020. Also, disabled persons planning to attend the public zoom hearing are asked to contact the Commission at
587-0214 prior to the hearing to indicate they have special needs that require accommodation.
