Kauai County Housing Agency Legal Public Notice for Public Comment On Draft Action Plan for County of Kauai’s Community Development Block Grant for Disaster Recovery Kauai County Housing Agency (KCHA) gives notice of the draft Action Plan for Disaster Recovery in compliance with federal regulations under 24 CFR § 91.105, for citizen participation in Community Planning and Development Programs under the U.S. Department of Housing and Urban Development, modified by waivers and alternative requirements of Federal Register Notice 83 FR 40317, and further clarified at 85 FR 4681, for the Disaster Recovery Appropriation under Public Law 116-20. Under Public Law 116-20, KCHA will receive $9,176,000 in Community Development Block Grant funds for Disaster Recovery (CDBG-DR), to address long-term recovery and restoration of infrastructure and housing, economic revitalization, and mitigation following severe flooding and landslides on Kauai in April 2018. Eligible CDBG-DR activities include, but are not limited to, repairing damaged infrastructure such as roads, utilities and public facilities, addressing unmet housing needs, specifically the needs of low and moderate income persons and vulnerable populations, and economic redevelopment for the purpose of retaining or creating jobs, especially those held by low and moderate income persons. A prerequisite of being awarded CDBG-DR funds under 85 FR 4681 and Prior Notices, includes developing an Action Plan for Disaster Recovery (AP). The draft AP, and all substantial amendments, are to be posted on KCHA’s web page for public review and comment, as a contingency of HUD approval of the AP. A 30-day public comment period is required for CDBG-DR. 85 FR 4681 and Prior Notices describe specific requirements that must be covered in the AP including an unmet needs assessment and proposed use of CDBG-DR funds. Eligible projects selected for CDBG-DR funding will be proposed in subsequent amendments to the AP and posted on KCHA’s web page for public review and comment. The draft AP will be posted from July 1, 2020-July 31, 2020 on KCHA’s disaster recovery page found at https://www.kauai.gov/Government/Departments-Agencies/Housing-Agency/Community-Development-Block-Grant-Disaster-Recovery-Program.
