PUBLIC HEARING NOTICE
Repeal of the Amended Policy, Rules and Regulations Governing
Recreational Stops by Commercial Tour Companies in
City Parks And the Adoption of Title 19, Chapter 17,
City and County of Honolulu Administrative Rules,
“Rules and Regulations Governing Recreational Stops”
Notice is hereby given of proposed rule repeal, rulemaking and public hearing by the Department of Parks and Recreation, City and County of Honolulu, to consider the repeal of the Amended Policy, Rules and Regulations Governing Recreational Stops by Commercial Tour Companies in City Parks and the adoption of proposed Title 19, Chapter 17, City and County of Honolulu Administrative Rules, governing recreational stops.
The Department of Parks and Recreation proposes to repeal existing rules governing commercial recreational stops by commercial tour companies and adopt new rules governing commercial recreational stops. The proposed rules establish the application requirements and process for a licensed motor carrier to obtain a permit to conduct a recreational stop at a beach park; limit the maximum number of permits to five permits per month per park district; authorize the payment of a permit fee as established by ordinance; limit a recreational stop to ninety minutes; identify the beach parks where recreational stops are permitted or prohibited; establishes the reasons for denial or revocation of a permit; and establishes penalties for revocation or violations of the permit conditions and administrative rules.
The proposed new rules are summarized as follows:
§19-17-1 Summary of the purposes for adoption of the rules.
§19-17-2 Application of the rules to beach parks, excluding Hanauma Bay Nature Preserve.
§19-17-3 Definitions.
§19-17-4 Penalty of up to $500 and 30-day imprisonment for violation of a rule or permit condition.
§19-17-6 Permit requirement to conduct a recreational stop in a beach park. No permit is required if the recreational stop does not exceed fifteen (15) minutes.
§19-17-7 Permit application requirements and process.
§19-17-8 Permit fees.
§19-17-9 Permit conditions including permit duration of one calendar month, and general liability insurance requirements.
§19-17-10 Regulations governing recreational stops including listing of beach parks where recreational stops are prohibited; parking requirements; limiting recreational stops to Monday – Friday, excluding state and federal holidays; and activities prohibited during a recreational stop.
§19-17-12 Bases for denial or revocation of a permit and penalties for permit revocation.
A public hearing will be held on June 9, 2020, in the Mission Memorial Auditorium at 550 South King Street, Honolulu Hawaii 96813, starting at 2:00 p.m. and ending at 4:00 p.m.
All interested persons are urged to attend the public hearing and present data, views, or arguments in the time limit provided, for consideration by the Department of Parks and Recreation. Persons unable to attend or wishing to present additional comments may mail written testimony to the Department of Parks and Recreation, Executive Services Division, 1000 Uluohia Street, Suite 309, Kapolei, Hawaii 96707, no later than June 9, 2020.
A copy of the rules to be repealed and proposed rules shall be mailed to any person who submits a written request to the above address and pays the required fee of $5.40 for the cost of duplicating the documents and postage. A complete set of the current rules to be repealed and proposed rules is also available, free of charge, on the City’s internet web site: http://www.Honolulu.gov/parks/.
