Chapter 13-84, Samoan Crab And Chapter 13-89,
Spiny Lobster or Ula and Slipper Lobster or Ula Papapa
The Department of Land and Natural Resources (DLNR) will hold joint informational meetings and public hearings on the proposed amendment and compilation of the Hawaii Administrative Rules (HAR) Chapter 13-95, rules regulating the taking and selling of certain marine resources, and the proposed repeal of HAR chapters 13-84, Samoan crab, and 13-89, spiny lobster or ula and slipper lobster or ula papapa. The proposed changes would update and consolidate administrative rules regulating the take, possession, and sale of Samoan crab, Kona crab, and lobster. It would also incorporate into administrative rules the statutory prohibition on the take and killing of female spiny lobster, Kona crab, and Samoan crab found in section 188-58.5, Hawaii Revised Statutes. This action will facilitate compliance by making it easier for the public to find all applicable regulations on these crustacean species. The proposed administrative rulemaking actions would not result in any substantive changes to existing laws, so the taking, possession, or sale of these resources will not be affected.
The joint informational meetings and public hearings will be held at the following times and locations: Tuesday, January 7, 2020 at the Kealakehe High School Cafeteria, 74-5000 Puohulihuli Street, Kailua-Kona, Hawaii from 5:30 to 8:30 p.m.; at the Chiefess Kamakahelei Middle School Cafeteria, 4431 Nuhou Street, Lihue, Kauai from 5:30 to 8:30 p.m.; at the Lanai Public Library, 555 Fraser Avenue, Lanai City, Lanai from 1:00 to 3:00 p.m.; and at the Mitchel Pauole Center Conference Room, 90 Ainoa Street, Kaunakakai, Molokai from 1:00 to 3:00 p.m.; Wednesday, January 8, 2020 at the Stevenson Middle School Cafeteria, 1202 Prospect Street, Honolulu, Oahu from 5:30 to 8:30 p.m.; and at the Maui Division of Aquatic Resources Office Conference Room, 130 Mahalani Street, Wailuku, Maui; and on Thursday, January 9, 2020 at the Hilo State Building Conference Room, 75 Aupuni St., Hilo, Hawaii from 5:30 to 7:30 p.m.
All interested persons are urged to attend the public hearing to present relevant information and individual opinion for the DLNR to consider. Persons unable to attend or wishing to present additional comments may mail written testimony by Friday, January 24, 2020 to the Division of Aquatic Resources (DAR), 1151 Punchbowl Street, Room 330, Honolulu, HI 96813.
Anyone with a hearing impairment who desires to attend the public hearing may request assistance of a sign language interpreter. The request will need to be received at least seven days before the hearing is scheduled to start. Additional information or a copy of the proposed rules will be mailed at no charge upon receipt of verbal or written request.
