NOTICE OF PUBLIC HEARING
Pursuant to sections 91-3 and 92-41, Hawaii Revised Statutes (HRS), notice is hereby given that the Department of Human Services will hold a public hearing to consider the amendment and compilation of existing administrative rules and the repeal of existing administrative rules for the Social Services Division (SSD), Adult Protective and Community Services Branch (APCSB), for the purpose of conforming to federal and state statutes and to more accurately describe current practices of the programs. Brief descriptions of the proposed amendment and compilation, and repeal of rules are listed below.
CHAPTER 17-1403, AVAILABILITY AND COST OF ADMINISTRATIVE RULES
The amendments to this chapter provide clarity regarding the conditions under which the department shall make its administrative rules available to the public and to establish the costs for copies. Amendments also specify that the administrative rules are available electronically via the department’s website.
CHAPTER 17-1404, FRAUD
The term “fraud” is defined as a knowing false statement or misrepresentation of a fact that results in the receipt of a benefit that would not otherwise result without the false statement. Provisions in this chapter specify that suspected fraud shall be identified and investigated.
CHAPTER 17-1417, ADULT DAY CARE SERVICES
This chapter is obsolete and is being repealed. The provision of adult day care services was transferred from the Social Services Division to the Med-QUEST Division as part of the expanded access to the department’s medical assistance program.
CHAPTER 17-1419, CHORE SERVICES
This chapter is obsolete and is being repealed. The provision of chore services was transferred from the Social Services Division to the Med-QUEST Division as part of the expanded access to the department’s medical assistance program.
CHAPTER 17-1439, HOME AND COMMUNITY BASED SERVICES FOR THE
DEVELOPMENTALLY DISABLED/MENTALLY RETARDED
This chapter is obsolete and is being repealed. The administration of this program was transferred from the Social Services Division to the Med-QUEST Division and is described in Chapter 17-1735.1, Hawaii Administrative Rules.
CHAPTER 17-1454, REGULATION OF HOME AND COMMUNITY-BASED CASE MANAGEMENT
AGENCIES AND COMMUNITY CARE FOSTER FAMILY HOMES
This chapter is obsolete and is being repealed. The administration of this program was transferred from the Department of Human Services, Social Services Division to Department of Health, Office of Health Care Assurance and is described in Chapter 11-800, Hawaii Administrative Rules.
