Pursuant to Chapter 91, Hawaii Revised Statutes, notice is hereby given that the Department of Health (DOH) will hold a public hearing for the proposed amendment and compilation of Hawaii Administrative Rules (HAR) Title 11 Chapter 186, “Certificate of Need Program.”
Title 11 Chapter 186, “Certificate of Need Program,” establishes rules to carry out the provisions of Chapter 323D, Hawaii Revised Statutes (HRS) relating to the administration of the certificate of need program by the State Health Planning and Development Agency (SHPDA). The rules shall be liberally construed to promote mandatory planning for health care facilities and health care services in the State, to promote accessibility for all the people of the State to quality health care services at reasonable cost and to promote the development of health delivery systems that meet the people’s health care needs.
The proposed changes will update medical terminology, update references and citations to the Code of Federal Regulations, state rules and statutes. The amendment will resolve inconsistencies in the rules that are present because of amendments made to Chapter 323D, Hawaii Revised Statutes, will delete minor standard categories of services, and standard categories which have been exempted through statute. The amendment will also make housekeeping changes for clarification purposes.

Time: 10:00 a.m. – 11:00 a.m.
Place: Oahu – Department of Health, Kinau Hale Board Room, 1st Floor ,1250 Punchbowl Street Honolulu, HI 96816; check in at the guard desk as you will need to sign-in and present identification. The Hearing will be conducted in-person on Oahu and video conferenced to neighbor island locations as follows:
Hawaii – Hilo State Office Building, 75 Aupuni Street
Video Conference Center in the basement.
Kauai – Lihue State Office Building, 3060 Eiwa Street
Video Conference Center in the basement.
Maui – Wailuku State Office Building, 54 South High Street

PUBLIC TESTIMONY
All interested persons shall be afforded the opportunity to submit testimony, orally or in writing, on the proposed administrative rules at the time of the public hearing. Persons who are not able to attend the public hearing may submit written testimony to the DOH by mail at the State Health Planning and Development Agency, 1177 Alakea Street, Room 402, Honolulu, Hawaii 96813 or by email at Romala.Radcliffe@doh.hawaii.gov. All testimony shall be received no later than Wednesday, June 5, 2019 at 4:00 p.m Hawaii Standard Time.
Any person requiring a special accommodation (e.g. assistance of a sign language interpreter) at the public hearing shall file a request with the DOH by email at Romala.Radcliffe@doh.hawaii.gov or by calling (808) 586-4524, at least ten business days before the public hearing date and location of choice as identified above.
Oral testimony shall be limited to three (3) minutes per testifier.
