REQUEST FOR PUBLIC COMMENTS
ON DRAFT AIR PERMIT
REGULATING THE EMISSIONS OF AIR POLLUTANTS
(Docket No. 18-CA-PA-22)
Pursuant to Hawaii Revised Statutes (HRS), Chapter 342B-13 and Hawaii Administrative Rules
(HAR), Chapter 11-60.1, the Department of Health, State of Hawaii (DOH), is requesting public
comments on a DRAFT PERMIT presently under review for:
Covered Source Permit (CSP) No. 0863-01-C
Application for Initial Covered Source Permit No. 0863-01
Application for Renewal Nos. 0088-07 and 0088-17
IES Downstream, LLC
Kapolei Terminal
Located At: 91-480 Malakole Street, Kapolei, Oahu
The DRAFT PERMIT is described as follows:
The existing Kapolei Refinery is currently permitted to operate under CSP No. 0088-01-C.
The applicant plans to separate the existing refinery into refinery operations and terminal
operations. This is an application for an initial CSP for only certain equipment (see below)
currently permitted to operate under CSP No. 0088-01-C.
1. Equipment in the LPG Refrigeration System and Blending and Shipping Areas subject to
Leak Detection and Repair (LDAR) monitoring (CSP No. 0088-01-C, Attachment II(A));
2. All storage tanks in the Blending and Shipping Area (CSP No. 0088-01-C, Attachment
II(B) & insignificant activities);
3. Tanks T-104, T-113, T-162, T-163, and T-235 (CSP No. 0088-01-C, Attachment II(B),
with Benzene Waste Operations NESHAP (BWON) requirements added);
4. Truck loading rack (CSP No. 0088-01-C, Attachment II(C));
5. Tank T-113 and T-104 (CSP No. 0088-01-C, Attachment II(F));
6. LPG pressurized tanks (insignificant activities); and
7. Asphalt tanks (insignificant activities).
The terminal is subject to the following federal regulations:
1. 40 CFR Part 60, Subpart GGG: Standards of Performance for Equipment Leaks in
Petroleum Refineries (applies to equipment – valve, pump, flange, etc. – in VOC/VOL
service associated with the LPG Refrigeration System)
2. 40 CFR Part 61, Subpart FF: National Emission Standard for Benzene Waste Operations
(applies to storage tanks 104, 113, 162, 163, and 235)
3. 40 CFR Part 63, Subpart CC: National Emission Standards for Hazardous Air Pollutants
from Petroleum Refineries (applies to Blending and Shipping Area and Liquid Fuel
System, petroleum storage tanks, and petroleum truck loading rack)
4. 40 CFR Part 68: Chemical Accident Prevention Provisions (applies to the storage and
use of flammable substances in the facility.
The terminal’s potential emissions are as follows:
The ADMINISTRATIVE RECORD, consisting of the APPLICATION and
non-confidential supporting materials from the applicant, the permit review summary, and the
DRAFT PERMIT, is available for public inspection during regular office hours, Monday through
Friday, 7:45 a.m. to 4:15 p.m., at the following location:

All comments on the draft permit and any request for a public hearing must be in writing,
addressed to the Clean Air Branch at the above address and must be postmarked or received
by October 24, 2018.
Any person may request a public hearing by submitting a written request that explains the
party’s interest and the reasons why a hearing is warranted. The DOH may hold a public
hearing if a hearing would aid in DOH’s decision. If a public hearing is warranted, a public
notice for the hearing will be published at least thirty days in advance of the hearing.
Interested persons may obtain copies of the administrative record or parts thereof by paying
five cents per page copying costs. Please send written requests to the CIean Air Branch
listed above or call Mr. Darin Lum at the Clean Air Branch at (808) 586-4200. Electronic
copies of the draft permit and permit review may be found online at http://health.hawaii.gov/
cab/public-notices/.
Comments on the draft permit should address, but need not be limited to, the permit
conditions and the facility’s compliance with federal and state air pollution laws, including: (1)
the National and State Ambient Air Quality Standards; and (2) HRS, Chapter 342B and HAR,
Chapter 11-60.1.
DOH will make a final decision on the permit after considering all comments and will send
notice of the final decision to each person who has submitted comments or requested such
notice.
