PUBLIC NOTICE
(Docket No. 18-CA-PA-20)

The Department of Health, State of Hawaii, is notifying all interested persons of the proposed settlement between the Department of Health and Mauna Loa Macadamia Nut Corporation. The Department of Health has issued a Notice and Finding of Violation and Order, in Docket No. 16-CA-EO-08, alleging that Mauna Loa Macadamia Nut Corporation violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2, and Covered Source Permit (CSP) No. 0317-02-C for exceeding the maximum emissions limit for particulate matter of 0.4 pounds of particulate matter per 100 pounds of biomass burned (lbs/100 lbs) while the boiler is fired on biomass or biomass in combination with used oil. On November 8, 2015, the average test results showed that the particulate matter emissions were 1.65 lbs/100 lbs.

A Consent Order has been drafted that proposes to settle this case. Interested persons may submit written comments on this proposed settlement to the Department of Health within 30 days of this notice. Comments should be sent to Ms. Marianne Rossio, P.E., Manager, Clean Air Branch, Department of Health, P.O. Box 3378, Honolulu, Hawaii, 96801-3378. The proposed Consent Order and the Notice and Finding of Violation and Order is available for public review during the regular office hours, Monday through Friday, 7:45 a.m. to 4:15 p.m. at the following locations:
