1. The City Council initiated four Resolutions associated with amending Chapter 21, Revised Ordinances of Honolulu (ROH), 1990, Land Use Ordinance (LUO), pertaining to Short-Term Rentals (STRs). They are summarized as follows:

Allows bread and breakfast homes (B&Bs) and transient vacation units (TVUs) in Residential, Apartment and Country Districts with a Conditional Use Permit (minor); specifies standards for CUPs
Limits the total number of B&Bs and TVUs island wide
Recreates/extends non-conforming use certificates (NUCs) made illegal in 1989
Restricts advertising
Increases fines for violations
17-164 5/25/17 “Proposing an amendment to Chapter 21, Revised Ordinances of Honolulu, 1990 (The Land Use Ordinance), relating to certain visitor accommodations.”

2. RELATING TO SHORT-TERM RENTALS

Rather than recommending the adoption of one or several of the Council’s bills, the Department of Planning and Permitting (DPP) has drafted its own omnibus bill for consideration. This bill incorporates many components from the Council’s Resolutions and addresses the concerns put forward by the Mayor’s Information Group, as well as those concerns raised by other entities and members of the public. DPP’s proposed bill amends certain provision of the ROH, as amended, including Chapter 8 Real Property Tax, Chapter 21 land Use Ordinance, and Chapter 40 Prohibited Activities in the City, and taking action in those portions of the proposal.

NOTE: The Planning Commission will ONLY be reviewing the amendments associated with Chapter 21 (The Land Use Ordinance).

Attendance at the public hearing is not necessary to submit written testimony. Persons wishing to present oral testimony, please register on-site on the day and time of the hearing. Fifteen (15) copies are requested, if submitting written testimony on-site on the day of the hearing.
