PUBLIC NOTICE

The Department of Health, State of Hawaii, is notifying all interested persons of the proposed settlement between the Department of Health and Kauai Island Utility Cooperative. The Department of Health has issued a Notice and Finding of Violation and Order, in Docket No. 14-CA-EO-09, alleging that Kauai Island Utility Cooperative violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2, and Covered Source Permit (CSP) No. 0452-01-C for exceeding the maximum emissions limit for ammonia. The ammonia emissions averaged 3.16 lbs/hr and 10 ppmvd @ 15% O2, over a rolling three-hour (3-hour) period.
A Consent Order has been drafted that proposes to settle this case. Interested persons may submit written comments on this proposed settlement to the Department of Health within 30 days of this notice.
