NOTICE OF PUBLIC HEARING ON
CHANGES TO HAWAII ADMINISTRATIVE RULES (HAR), TITLE 11,
CHAPTER 55, ENTITLED "WATER POLLUTION CONTROL"
DEPARTMENT OF HEALTH
STATE OF HAWAII

The Department of Health (DOH) will receive written comments and hold a public hearing on proposed changes to Hawaii Administrative Rules (HAR), Chapter 11-55, Water Pollution Control.

The proposed revisions to National Pollutant Discharge Elimination System (NPDES) General Permits in the Appendices of HAR, Chapter 11-55 include the following:

Renewal and revision of the NPDES General Permit Authorizing Discharges of Treated Effluent from Leaking Underground Storage Tank Remedial Activities (Appendix D).
Renewal and revision of the NPDES General Permit Authorizing Discharges of Once Through Cooling Water Less Than One (1) Million Gallons Per Day (Appendix E).
Renewal and revision of the NPDES General Permit Authorizing Discharges of Hydrotesting Waters (Appendix F).
Renewal and revision of the NPDES General Permit Authorizing Discharges Associated with Construction Activity Dewatering (Appendix G).
Renewal and revision of the NPDES General Permit Authorizing Discharges of Treated Process Wastewater Associated with Petroleum Bulk Stations and Terminals (Appendix H).
Renewal and revision of the NPDES General Permit Authorizing Discharges of Treated Process Wastewater Associated with Well Drilling Activities (Appendix I).
Renewal and revision of the NPDES General Permit Authorizing Point Source Discharges of Application Pesticides (Appendix M).

Proposed revisions to the main body of HAR, Chapter 11-55 include:

Added requirement to clarify the deadline for permittees to renew coverage under Individual NPDES permits.
Added the expiration date of certain general permits in the HAR, Chapter 11-55 Appendices.
Added deadlines and procedures for appeals to NPDES permits including permittees responsibility for public notification costs for modifications to permits.
Added requirements for documents that must be retained at the project site or office.
Corrected and updated references to Federal and State laws or rules.

The public hearing will be held on Oahu at 10:00 a.m. on Wednesday, December 13, 2017, in the Auditorium of the Department of Health, Laboratory Division, located at 2725 Waimano Home Road, Pearl City, Hawaii 96782. Teleconference sites will be open from 10:00 a.m. on Wednesday, December 13, 2017, at the following locations:

Persons desiring to speak are asked to submit two (2) copies of their statement before or at the hearing. Written statements will also be accepted until 4:30 p.m. on Wednesday, December 13, 2017, at the Clean Water Branch, Environmental Management Division, State Department of Health through E-mail at cleanwaterbranch@doh.hawaii.gov or at P. O. BOX 3378, Honolulu, HI 96801-3378.
