NOTICE
The Council of the City and County of Honolulu at its meeting held on June 5, 2024, laid over and ordered published the following Resolution. Pursuant to Section 3-202.9 of the Revised Charter of the City and County of Honolulu 1973, as amended, the Honolulu City Council hereby gives notice that the following Resolution authorizing proceedings in eminent domain has been introduced and is under its consideration:
RESOLUTION 24-78 (FOR CONDEMNATION) PROVIDING FOR THE ACQUISITION OF ACCESS EASEMENTS FOR PUBLIC USE TO THE KALAUAO (PEARLRIDGE) BUS TRANSIT CENTER AND MOBILITY HUB, LOCATED AT WAIMALU, ‘EWA, O’AHU, HAWAI’I, AND DETERMINING AND DECLARING THE NECESSITY OF THE ACQUISITION BY EMINENT DOMAIN.
BE IT RESOLVED by the Council of the City and County of Honolulu:
I.
The valid public use and purpose for the acquisition of easements for access to the Kalauao (Pearlridge) Bus Transit Center and Mobility Hub which will promote the use of public transportation, mitigate traffic congestion, improve environmental quality, foster economic development, and provide cost effective transportation access for the public. A lawsuit for eminent domain shall be filed to acquire perpetual, exclusive easement for access purposes, over, under and across the entire easement identified as Parcels A-4 and a perpetual, non-exclusive easement for access purposes, over, under and across the entire easement identified as Parcel A-5 (TMK: 9-8-009-011), both located at Waimalu, ‘Ewa, O’ahu, Hawai’i, and more particularly described in the legal descriptions and maps in the attached Exhibit A. The Corporation Counsel of the City and County of Honolulu is hereby authorized to file the lawsuit for eminent domain.
Eminent Domain is necessary for the public use and purpose described above.
