State of Hawaii. Department of Transportation, 601 Kamokila Boulevard, Room #609, Kapolei, Hawaii 96707, has applied to the Department of Health for a variance from Hawaii Administrative Rules, Chapter 11-46, Section 11-46-6(a), which states, "General Prohibition. Without a permit or variance issued pursuant to section 11-46-7 or 11-46-8, no person within the State shall operate, from any premises or land owned, rented, leased, occupied, or controlled by that person, any excessive noise source."

The applicant proposes roadway resurfacing and reconstruction on the Moanalua Freeway, Interstate Route H-201; Eastbound Halawa On-Ramp to Ala Kapuna Road (MP 0.81 to MP 1.5), Westbound Halawa Valley Stadium Off-Ramp to Fort Shafter Off-Ramp (MP 0.86 to MP 4.0), and the Exit 1E Off-Ramp to the vicinity of Ulune Street, on the island of Oahu.

The applicant would like to conduct construction related activities all day on Sunday (12:01 a.m. – 7:00 a.m. and 8:30 p.m. – Midnight), Monday night through Friday morning (12:01 a.m. to 5:30 a.m. and 9:00 p.m. to midnight), and Saturday (12:01 a.m. to 6:30 a.m.) from January 2024 until October 2025.

The Department of Health will retain and consider all written comments received not later than thirty (30) days after the date of this notice. If the comments received warrant it, the Department may hold a public hearing, after at least thirty (30) days public notice, on the variance application. The final decision will be made on the basis of the application, related documents, written comments and the public hearing, if any.
