PUBLIC HEARING NOTICE
Repeal of the City and County of Honolulu Administrative
Rules entitled “Shore Water Events”
And the Adoption of Title 19, Chapter 25, City and County of Honolulu Administrative Rules, “Rules and Regulations Governing Shore Water Events”


Notice is hereby given of proposed rule repeal, rulemaking, and public hearing by the Department of Parks and Recreation, City and County of Honolulu, to consider the repeal of the Shore Water Events rules and the adoption of proposed Title 19, Chapter 25, City and County of Honolulu Administrative Rules, governing shore water events.

The Department of Parks and Recreation proposes to repeal existing rules governing shore water events. The proposed rules add new definitions and clarify existing definitions; change how applications for north shore and south shore events are ranked; modify the north shore surf calendar from a calendar year to a surf season calendar; adopt new regulations governing surfing events for the south shore; and creates an after-event report for north shore and south shore events.

The proposed new rules are summarized as follows:

§19-25-1 Purposes for the adoption of the rules.
§19-25-2 Identifies that these rules apply to City parks.
§19-25-3 Definitions have been added and existing definitions have been amended.
§19-25-4 States that a park use permit is required to hold a shore water event.
§19-25-5 Establishes the permit application process.
§19-25-6 Identifies the permit application deadline for surf events held on the north shore.
§19-25-7 Identifies the permit application deadline for surfing events held on the south shore.
§19-25-8 Identifies the conditions for a park permit.
§19-25-9 Identifies when a permit may be revoked.
§19-25-10 Establishes the regulations that will govern shore water events.
§19-25-11 Establishes the regulations that will govern surf events held on the north shore.
§19-25-12 Establishes the regulations that will govern surfing events held on the south shore.
§19-25-13 Establishes the system for ranking applications on the north shore and south shore calendars.
§19-25-14 Requires a permittee to indemnify the City.
§19-25-15 Establishes the criteria to deny or revoke a permit.
§19-25-16 Establishes penalties for violation of the rules.

An in-person and virtual public hearing will be held on October 20, 2023 from

All interested persons are urged to attend the public hearing and present data, views, or arguments in the time limit provided, for consideration by the Department of Parks and Recreation. Persons unable to attend or wishing to present additional comments may mail written testimony to the Department of Parks and Recreation, Executive Services Division, 1000 Ulu’ohi’a Street, Suite 309, Kapolei, Hawai’i 96707, no later than October 27, 2023.

Interested persons may review the current rules to be repealed and proposed rules starting today and ending five days prior to the day of the public hearing during the hours of 7:45 a.m. to 4:30 p.m. at the Department of Parks and Recreation, 1000 Uluohia Street, Suite 309, Kapolei, Hawaii 96707.

A copy of the rules to be repealed and proposed rules shall be mailed to any person who submits a written request to the above address and pays the required fee of $12.10 for the cost of duplicating the documents and postage. A complete set of the current rules to be repealed and proposed rules is also available, free of charge, on the Honolulu Department of Parks and Recreation’s internet website under the “Rules & Regulations” tab: http://www.honolulu.gov/parks/
