Notice is hereby given that the Kaua’i County Council will hold a public hearing on May 31, 2023, at 8:30 a.m., or soon thereafter, at the Council Chambers, 4396 Rice Street, Room 201, Historic County Building, Lihu’e, on the following:

A BILL FOR AN ORDINANCE AMENDING CHAPTER 22, ARTICLE 15,
KAUA’I COUNTY CODE 1987, AS AMENDED, RELATING TO GENERAL PROVISIONS RELATING TO PUBLIC HEALTH, SAFETY AND WELFARE (OBNOXIOUS SUBSTANCES)
This Bill proposes to repeal the existing Chapter 22, Article 15 in its entirety, and to provide a new Chapter 22, Article 15, entitled “Possession and Use of Pepper Spray for Self-Defense or Defense of Others.” The new Article 15 allows for the sale and use of pepper spray in volumes no greater than two (2) ounces when contained in a device that prevents accidental release and is nonflammable. This Article also allows for the use of pepper spray for self-defense, defense of others, and for the protection of property. Exceptions for certain government entities and private organizations are provided, as well as penalties for violations.
Any person may testify at the public hearing, and at any Council and Committee Meeting (at which time any Bill may be amended).
