NOTICE

The Council of the City and County of Honolulu at its meeting held on September 8, 2021, laid over and ordered published the following Resolutions. Pursuant to Section 3-202.9 of the Revised Charter of the City and County of Honolulu 1973, as amended, the Honolulu City Council hereby gives notice that the following Resolutions authorizing proceedings in eminent domain have been introduced and are under its consideration:

RESOLUTION 21-114, CD1 (FOR CONDEMNATION) PROVIDING FOR THE ACQUISITION OF EASEMENTS FOR PUBLIC USE FOR THE REHABILITATION OF NUMANA ROAD BRIDGE OVER KALIHI STREAM, BRIDGE NO. 129, LOCATED AT KAAHALOA, KUPEHAU, OR LAELAE, KALIHI VALLEY, HONOLULU, OAHU, HAWAII, AND DETERMINING AND DECLARING THE NECESSITY OF THE ACQUISITION BY EMINENT DOMAIN.

BE IT RESOLVED by the Council of the City and County of Honolulu:

I.

The valid public use and purpose for the acquisition of easements is for the improvement, repair, and rehabilitation of the Numana Road Bridge over Kalihi Stream, Bridge No. 129, to improve service to the residents of the area. An eminent domain lawsuit shall be filed to acquire bridge maintenance easements identified as Parcels 1A (TMK: 1-4-017-001), 2A (TMK: 1-4 -017-028), 3A (TMK: 1-4-017-road), 4A (TMK: 1-4-017-033), 5A (TMK: 1-4-009-007), and 6A (TMK: 1 4-009-road), and a temporary construction easement over, under, through, and across Parcel C1, located at Kaahaloa, Kupehau, or Laelae, Kalihi Valley, Honolulu, Oahu, Hawaii, and more particularly described in the legal descriptions and maps in the attached Exhibit A. The Corporation Counsel Designate of the City and County of Honolulu is hereby authorized to file the eminent domain lawsuit.

Eminent Domain is necessary for the public use and purpose described above.

AYES: Councilmembers Cordero, Elefante, Fukunaga, Kia’aina, Say, Tsuneyoshi, Tulba, Tupola, Waters. – 9.

RESOLUTION 21-148 (FOR CONDEMNATION) PROVIDING FOR THE ACQUISITION OF LAND FOR PUBLIC USE OF 1615 ALA WAI BOULEVARD, LOCATED AT KALIA, WAIKIKI, HONOLULU, OAHU, HAWAII, AND DETERMINING AND DECLARING THE NECESSITY OF THE ACQUISITION BY EMINENT DOMAIN.

BE IT RESOLVED by the Council of the City and County of Honolulu:

I.

The valid public use and purpose for the acquisition of land is to renovate and/or develop affordable rental housing in Honolulu. An eminent domain lawsuit shall be filed to acquire the land, in fee simple, identified as 1615 Ala Wai Boulevard, Parcels 1 and 2 (TMK: 2-6-011-033) and 3 (TMK: 2-6-011-036), located at Kalia, Waikiki, Honolulu, Oahu, Hawaii, and more particularly described in the legal descriptions and map in the attached Exhibit A. The Corporation Counsel of the City and County of Honolulu is hereby authorized to file the eminent domain lawsuit.

Eminent Domain is necessary for the public use and purpose described above.
