NOTICE OF ISSUANCE OF NOTICE OF INTENT
TO VACATE AND REMAND
State of Hawaii,
Labor and Industrial Relations Appeals Board
In the Matter of Attorney’s Fees Pertaining to PAUL D. SCHMEDING, ESQ. In the case of DANIEL DIAL vs. ALTRES, INC., et al.; AB 2011-400; 2-07-08232

TO: A COURT-APPOINTED REPRESENTATIVE OR SPECIAL ADMINISTRATOR OF THE ESTATE OF DANIEL DIAL and the SURVIVORS OF DANIEL DIAL, or legal counsel thereof:
On May 8, 2012 and March 12, 2013, while the underlying workers’ compensation case of Daniel Dial was pending before the Labor and Industrial Relations Appeals Board, the Director of Labor and Industrial Relations issued inconsistent Approvals of Attorney’s Fees. On May 11, 2012, Paul D. Schmeding appealed the Director’s May 8, 2012 approval. Upon information and belief, Claimant died on February 2, 2012. To date, no court-appointed legal representative of Claimant’s estate has appeared in this appeal.
YOU ARE HEREBY NOTIFIED that on June 23, 2021, the Board issued a Notice of Intent to Vacate and Remand. The Board intends to vacate the May 8, 2012 and March 12, 2013 approvals and remand this matter to the Director for issuance of an Approval of Attorney’s Fee, unless a party files a written objection with the Board by August 31, 2021.
