NOTICE OF PUBLIC HEARING Pursuant to Chapter 91, Hawaii Revised Statutes (HRS), notice is hereby given that the State of Hawaii, Department of Transportation, Highways Division, will hold a public hearing to consider the proposed amendment and compilation of Chapter 19-108, Hawaii Administrative Rules, “High Occupancy Vehicle Lanes”. The purpose of the proposed rules is to implement Hawaii Revised Statutes (HRS) section 291C-222 which requires the Director of Transportation to amend and compile rules to: a. Sections 19-108-1 to 19-108-8 amend clarification and formatting. b. Section 19-108-2 The proposed amendment will add definition of “Electric Vehicle” (EV) means a vehicle as defined in HRS §291-71. c. The proposed amendment to include EVs in the vehicle exceptions. d. Compile the sections of the chapter. Act 168 Session Laws of Hawaii enacted in 2012 was repealed on June 30, 2020, due to the sunset clause. Part of Act 168 allowed EVs to use a HOV lane regardless of the number of persons in the vehicle. The Department of Transportation supports the continued exception for EVs to use HOV lanes and proposes to amend and compile Chapter 19- 108. A virtual public hearing will be held on February 9, 2021, at 9:00 am using Microsoft Teams.
